Um diagnóstico regional sobre a proteção internacional dos direitos reprodutivos

Abstract

Resumo: A presente pesquisa explora a questão da proteção dos direitos reprodutivos no contexto internacional, consistindo o problema de pesquisa os seguintes questionamentos: existem tratados internacionais específicos acerca de direitos reprodutivos? Como estes direitos são protegidos no contexto do Sistema Interamericano de direitos humanos? Parte-se da hipótese inicial de que os direitos reprodutivos não contam com tratado específico para sua salvaguarda, contudo, concluímos que, a partir de documentos não vinculantes, relatórios da Comissão Interamericana de Direitos Humanos e da Corte Interamericana de Direitos Humanos, é possível delinear de que modo os direitos reprodutivos estão sendo tratados em nosso sistema, identificando pontos para melhor desenvolvimento de mecanismos de proteção. Por fim, salienta-se que, com exceção do segundo capítulo, em que será realizada análise qualitativa de documentos internacionais, a metodologia utilizada predominantemente é a análise bibliográfica, adotando-se, ademais, o levantamento e triagem de casos contenciosos em que houve violação aos direitos reprodutivos e que estão na Comissão Interamericana de Direitos Humano, bem como aqueles que já possuem sentença proferida pela Corte Interamericana de Direitos Humanos

Abstract: This research explores the issue of protecting reproductive rights in the international context, with the research problem consisting of the following questions: are there specific international treaties on reproductive rights? How are these rights protected in the context of the inter-American human rights system? We start from the initial hypothesis that reproductive rights do not have a specific treaty to safeguard them, however, we conclude that, based on non-binding documents, reports from the Inter-American Commission on Human Rights and the Inter-American Court of Human Rights, it is possible to outline how reproductive rights are being treated in our system, identifying points for better development of protection mechanisms. Finally, it should be noted that, with the exception of the second chapter, in which a qualitative analysis of international documents will be carried out, the methodology predominantly used is bibliographic analysis, adopting, in addition, the survey and screening of contentious cases in which there was a violation of reproductive rights and which are before the Inter-American Commission on Human Rights, as well as those that already have a ruling issued by the Inter-American Court of Human Rights
