Poluição sonora : considerações sobre seus aspectos e a proteção legal

Abstract

Resumo: A poluição sonora é agressão ao meio ambiente que vem se destacando por sua crescente gravidade. As cidades estão cada vez mais ruidosas e como principal consequência as pessoas estão ficando com sua saúde bastante prejudicada. O presente trabalho procura demonstrar a nocividade da poluição sonora, expondo no subcapítulo 2.1 os conceitos que envolvem o tema, trazendo no subcapítulo 2.2 as fontes poluidoras e no subcapítulo 2.3 discorrendo sobre as possíveis consequências que derivam da poluição sonora. Para melhorar a qualidade de vida, alcançar um ambiente ecologicamente equilibrado e a preservação da dignidade humana, conforme se depreende do artigo 225 da Constituição Federal, é necessário eliminar a poluição sonora, fato este explanado no subcapítulo 2.4. A legislação aplicável ao tema vem exposta no subcapítulo 2.5, seguida no 2.6 pelas opções de tutela de proteção contra a poluição sonora, sejam através de medidas individuais ou coletivas, preventivas ou repressivas. O objetivo é fornecer um panorama geral sobre a poluição sonora, seus efeitos, possíveis fundamentos jurídicos e legais e a partir desta noção, demonstrar a relevância do tema com a necessidade de combater este tipo de poluição

Abstract: Noise pollution is a real aggression to the environment which has been highlighted by its increasing gravity. The cities are increasingly noisy and as the main consequence people are getting unhealthy. The present work seeks to demonstrate the harmfulness of noise pollution, exposing in sub-chapter 2.1 the concepts that involve the subject, bringing in sub-chapter 2.2 the polluting sources, and in sub-chapter 2.3 discussing the possible consequences that derive from noise pollution. To improve the quality of life, it is crucial to achieve an ecologically balanced environment and preserve human dignity, as it also can be seen from Article 225 in the the Federal Constitution, it is necessary to eliminate noise pollution, it is a fact explained in subchapter 2.4. The legislation applicable to the topic is set out in subchapter 2.5, followed in 2.6 by the protection options for protection against noise pollution, whether through individual or collective, preventive or repressive measures. The objective is to provide a general overview of noise pollution, its effects, possible legal bases and, based on this notion, demonstrate the relevance of the theme with the need to combat this type of pollution
