A lei do SNUC e as unidades de conservação de proteção integral em Goiás : uma análise da situação atual e do que é estabelecido por lei

Abstract

Resumo: A Lei 9.985/2000, também conhecida como Lei do SNUC, traz uma série de critérios para a criação e gestão das áreas protegidas, porém o que vemos na realidade são unidades de conservação criadas e abandonadas, não estando assim em conformidade com a legislação. As áreas protegidas integralmente são mais restritivas em suas regras e normas por isso deveriam dispor de um maior rigor quanto ao cumprimento da legislação. Essa, porém, não é a realidade atual em Goiás. Dessa forma, o presente trabalho faz uma análise das unidades de conservação de proteção integral no Estado, destacando pontos estabelecidos na gestão das UCs por meio do SNUC e que não estão sendo cumpridos. As deficiências vão desde o instrumento legal de criação, implementação e existência de um plano de manejo, passando pela regularização da situação fundiária da unidade, o uso dos seus entornos e a participação comunitária, recursos destinados à manutenção dessas áreas, projetos e pesquisa e retroalimentação, todas políticas necessárias à efetividade de uma UC de proteção integral, no entanto todos em desconformidade com o que é estabelecido pelo SNUC

Abstract: Law 9.985/2000, also known as the SNUC Law, provides a series of criteria for the creation and management of protected areas, but what we actually see are conservation units created and abandoned and are not in compliance with the legislation. Integral protected areas are more restrictive in their rules and regulations, so they should be more rigorous in enforcing legislation. This, however, is not the current situation in Goias.,The present work made an analysis of conservation units of integral protection in the State, highlighting points established in the management of the PAs through SNUC and that are not being fulfilled. As the deficiencies range from the legal instrument of creation, the implementation and the exhibition of a management plan, to the regularization of the situation of the land unit, the use of its surroundings and the community participation, the resources of maintenance ofthese areas, the projects, research and feedback, all policies applicable to the effectiveness of a full protection UC, however, all of them nonconformity with what is established by SNUC
