Licenciamento ambiental consorciado : aspectos jurídicos e a experiência do Consórcio Intermunicipal do Médio Vale do Itajaí - CIMVI

Abstract

Resumo: A distribuição demográfica brasileira historicamente se desenvolveu de maneira desigual. Tal fato, aliado ao surgimento de novos entes federativos locais após a Constituição de 1988, ainda hoje influi na má distribuição populacional e multiplicidade de realidades experimentadas a nível municipal no que tange à eficiência e autonomia financeira das prefeituras. Este cenário, somado à descentralização da política ambiental, aos anseios econômicos pelo desenvolvimento sustentável e aos custos de operacionalização de um órgão licenciador constitui empecilho ao exercício das competências comuns e delegação de novas atribuições para muitos municípios, seja pela saturação de incumbências, seja pela menor expressividade ou eficiência financeira. Por tais razões, o exercício da atividade de polícia ambiental preventiva por consórcio intermunicipal é alternativa ao incremento equitativo da gestão ambiental local e à concepção de ambiente favorável à atração e surgimento de novos impulsores econômicos atentos às condicionantes ambientais. Desta forma, o trabalho objetivou explorar de maneira concisa aspectos legais atinentes à competência e atribuições relacionadas ao poder de licenciar em matéria ambiental, à criação e implementação de consórcios intermunicipais e dados que demonstrem a experiência do Consórcio Intermunicipal do Médio Vale do Itajaí (CIMVI) mediante pesquisa bibliográfica e documental. Apurou-se que o modelo de gestão consorciada significou diversas vantagens aos municípios integrantes, desde a desburocratização e agilidade decorrentes do desfrute de órgão próprio até a percepção das taxas recolhidas, todos indicativos de um modelo viável

Abstract: Brazilian demographic distribution has historically developed unevenly. This fact, coupled with the emergence of new local federative entities after the 1988 Constitution, still influences the poor population distribution and multiplicity of realities experienced at the municipal level regarding the efficiency and financial autonomy of the municipalities. This scenario, coupled with the decentralization of environmental policy, the economic aspirations for sustainable development and the operating costs of a licensing body is a hindrance to the exercise of common competences and delegation of new duties to many municipalities, either by saturation of tasks or by the smallest. expressiveness or financial efficiency. For these reasons, the exercise of the preventive environmental police activity by an intermunicipal consortium is an alternative to the equitable increase of local environmental management and the conception of an environment favorable to the attraction and emergence of new economic drivers that are aware of environmental constraints.
