Natureza jurídica da licença ambiental

Abstract

Resumo: Analisa a natureza da licença ambiental, comparando-a, num primeiro momento, com os atos administrativos clássicos (autorização e licença), a fim de verificar se ela se enquadra em alguns desses institutos já existentes, bem como se possuem características semelhantes. Num segundo momento, passa-se a analisar e destacar as diferenças existentes entre a licença ambiental e os atos administrativos clássicos analisados (autorização e licença). Apenas após essa análise e constatadas as semelhanças e as diferenças existentes, passa-se a analisar a natureza jurídica da licença ambiental, que a torna num ato administrativo próprio, uma espécie de autorização sui generis, e, assim, conhecer os efeitos que a licença ambiental gera no mundo fenomênico e se estão de acordo com os princípios norteadores do Direito Ambiental

Abstract: It analyzes the nature of the environmental license. Firstly, comparing it with the traditional administrative acts (authorization and license) to see if it fits into some of these existing institutes and if they have similar characteristics. Secondly, the differences between the environmental license and the classic administrative acts analyzed (authorization and license) are analyzed and highlighted. Only after this analysis has been made and the similarities and differences have been established that the legal nature of the environmental license is analyzed, which makes it an administrative act of its own, a kind of sui generis authorization, and thus know the effects that the license in the phenomenal world does and if they are in accordance with the guiding principles of Environmental Law
