Uma análise da Lei Florestal 12.651/2012 e outras normas federais no tocante ao manejo florestal sustentável para produção de madeira na Amazônia brasileira

Abstract

Resumo: A Legislação Florestal brasileira apresenta-se como um dos instrumentos para regulamentar a preservação e utilização dos recursos florestais naturais por meio dos institutos Área de Preservação Permanente (APP) e Reserva Legal (RL). Desta forma o presente trabalho objetivou, de forma sucinta, uma análise da atual Lei Florestal brasileira e outras normas federais correlatas no tocante ao manejo florestal sustentável para produção madeireira nas florestas situadas no Bioma Amazônia. O manejo florestal sustentável pode ser realizado em área de RL, e nos imóveis rurais situados na Amazônia Legal ou Bioma Amazônia, são aplicados os seguintes percentuais sobre a área do imóvel: (I) em imóvel rural situado em área de florestas, 80% da área deve ser de RL (nesse percentual está incluso a APP), possibilitando o uso alternativo (corte raso), em até 20% da área do imóvel ; (II) em imóvel rural situado em área de cerrado, 35% da área do imóvel deve ser de RL, ou seja, até 65% da área do imóvel pode ser convertida em uso alternativo; (III) em imóvel rural situado em área de campos gerais, 20% da área do imóvel deve ser de RL, isto é, até 80% da área do imóvel pode ser convertida em uso alternativo. Na Lei Florestal atual (Lei Federal 12.651/2012) os artigos que regulamentam o manejo florestal sustentável para a produção madeireira são 12, 17, 20, 22, 31 e, complementados, principalmente pelas normas federais: Instrução Normativa 5/2006/MMA e Resolução 406/2009/CONAMA

Abstract: The Brazilian Forest Code is one of the instruments used to regulate the preservation and utilization of natural forest resources through the Permanent Preservation Area (PPA) and Legal Reserve (LR) institutes. Therefore, the present work has succinctly aimed at an analysis of the current Brazilian Forest Code and others related federal regulations, regarding sustainable forest management for timber production on forests located in the Amazon Biome. Sustainable forest management can be carried out in LR area, and in rural properties located in the Legal Amazon or Amazon Biome, the following percentages are applied over the area of the property: (I) in rural property located in forested area, 80% of the area must be LR (in this percentage is included PPA), allowing for alternative use (clear cutting), until 20% of the property area; (II) in rural property located in cerrado area, 35% of the property area must be LR, i.e. until 65% of the property area can be converted into alternative use; (III) in rural property located in fields area, 20% of the property area must be LR, i.e. until 80% of the property area can be converted into alternative use. In the current Forest Code (Federal Law 12.651/2012) the articles that regulate sustainable forest management for timber production are: 12, 17, 20, 22, 31 and complemented, mainly by federal Normative Instruction 5/2006/MMA and Resolution 406/2009/CONAMA
