Competência comum no direito ambiental e a segurança jurídica na implementação da logística reversa
Resumo
Resumo: Trata-se de trabalho que visa expor os conflitos judiciais referentes aos limites da competência legislativa concorrente dos entes da Federação para dispor sobre a logística reversa dos produtos e os conflitos judiciais referentes à implementação da logística reversa, bem como apresentar alternativa visando a segurança jurídica para as pessoas jurídicas responsáveis pela implementação da logística reversa. O método consiste no levantamento de casos judiciais sobre a logística reversa nos tribunais do país e estudo bibliográfico. Sugere-se aplicar a reserva do possível como princípio limitador da ingerência do Poder Judiciário, tendo como parâmetro os acordos setoriais de cada produto, porque calcados em estudos de viabilidade técnica e econômica e participação social, que são requisitos à implementação da logística reversa, conforme a Política Nacional de Resíduos Sólidos. Na esfera dos conflitos sobre os limites da competência para legislar, o Supremo Tribunal Federal definiu o conceito de interesse local para fins da delimitação da competência legislativa dos Municípios no âmbito do direito ambiental, sendo este acórdão parâmetro para os demais tribunais do país Abstract: This paper aims to expose the judicial conflicts regarding the limits of the legislative competence of the Federation entities to dispose on the reverse logistics of products and the judicial conflicts regarding the implementation of reverse logistics, as well as to present an alternative aiming at legal certainty for the legal entities responsible for implementing reverse logistics. The method consists in the survey of court cases on reverse logistics in the country's Courts and bibliographic study. It is suggested to apply the principle of reserve for contingencies as a limiting principle of the interference of the Judiciary, having as a parameter the sectoral agreements of each product, because based on technical and economic feasibility studies and social participation, which are requirements for the implementation of reverse logistics, as the National Policy on Solid Waste. In the sphere of conflicts over the limits of the competence to legislate, the Federal Supreme Court defined the concept of local interest for the purpose of delimiting the legislative competence of municipalities in the ambit of environmental law, and this judgment is a parameter for the other courts of the country
