Competência legislativa ambiental na República Federativa do Brasil

Abstract

Resumo: O presente artigo tem como objetivo traçar considerações sobre a necessidade de tutelar o meio ambiente através do Direito Ambiental utilizando-se o sistema federativo brasileiro tripartite. Para tanto, aborda o que se entende por meio ambiente e explora a repartição das competências legislativas ambientais. Trata das lacunas e os sombreamentos causados pela competência legislativa tripartite entre os entes União, estados e municípios, com risco à manutenção da segurança jurídica. Assim, realizar-se-á análise das competências ambientais na federação brasileira, identificando suas origens e apontando qual é o caminho a ser trilhado para que haja plena coordenação entre os diferentes entes federativos

Abstract: This article aims to draw considerations about need to protect the environment through Environmental Law using the Brazilian federal system tripartite. To this end, it addresses what is meant by the environment and explores the distribution of environmental competences. It deals with the gaps and shadowing caused by the tripartite legislative competence between the Union, states and municipalities, with a risk to the maintenance of legal certainty. Thus, an analysis of the environmental competences in the Brazilian federation will be carried out, identifying its origins and pointing out which path should be followed so that there is full coordination between the different federative entities
