A aplicação intertemporal e a segurança jurídica das leis ambientais em análise na jurisprudência brasileira

Resumo: O presente artigo fez uma explanação sobre a aplicação intertemporal das leis ambientais e suas implicações em face dos institutos da segurança jurídica e vedação ao retrocesso. Bem como fez analise jurisprudencial sobre a aplicação destes institutos em caso de aparente colisão de conflitos. Também se explanou sobre a teoria do fato consumado e sua relação com o direito adquirido e as teses que fundamentam sua inaplicabilidade na tutela ambiental. Para tanto se discorreu sobre as limitações da irretroatividade da norma em face ao princípio da segurança jurídica. Definiu-se o fato consumado e sua inaplicabilidade no direito ambiental, para em seguida analisar os precedentes jurisprudenciais que ensejaram em aplicação retroativa da lei ambiental sobre fatos consolidados. Para isto, realizou-se, uma pesquisa bibliográfica e documental, analisando conteúdos na doutrina, legislação e jurisprudência. Diante disso, verificou-se que no Supremo Tribunal Federal os princípios da segurança jurídica a da vedação ao retrocesso ambiental foram institutos relativizados no caso do surgimento de novas leis. No caso do fato consumado, observou-se que a jurisprudência entende que inexiste direito adquirido de uso da propriedade frente à tutela ambiental, podendo situações licitas se tornarem ilícitas diante de novas leis. Quanto à vedação ao retrocesso ambiental, percebeu-se um aparente impasse, entre a Superior e Suprema Corte, gerando um paradoxo sobre a aplicação dos princípios da segurança jurídica. O STJ se utiliza do tempus regit actum para garantir o direito adquirido da tutela ambiental e impedir, assim seu retrocesso. O STF, por sua vez, se utiliza da segurança jurídica para fundamentar a aplicação retroativa da Lei Federal 12.651/2012. Ofendendo a vedação ao retrocesso ambiental e mitigando o tempus regit actum. Abstract: The present article made an explanation about the intertemporal application of environmental laws and their implications in face of the institutes of legal security and prohibition against retrogression. As well as made jurisprudential analysis on the application of these institutes in the event of an apparent conflict of conflicts. It also explained about the theory of fait accompli and its relation with the acquired right and the theses that justify its inapplicability in environmental protection. For that reason, it was discussed about the limitations of the non-retroactivity of the rule in face of the principle of legal security. The fait accompli and its inapplicability in environmental law were defined, to then analyze the precedents of jurisprudence that gave rise to the retroactive application of environmental law on consolidated facts. For this, a bibliographic and documentary research was carried out, analyzing contents in the doctrine, legislation and jurisprudence. In view of this, it was found that in the Supreme Court the principles of legal certainty and the prohibition against environmental setback were instituted in the event of the emergence of new laws. In the case of the fait accompli, it was observed that the jurisprudence understands that there is no acquired right to use the property in the face of environmental protection, and that legal situations may become illegal under new laws. As for the prohibition against environmental setbacks, an apparent impasse was noticed between the Superior and Supreme Court, generating a paradox about the application of the principles of legal certainty. The STJ uses the tempus regit actum to guarantee the acquired right of environmental protection and prevent, therefore, its regression. The STF, in turn, uses legal security to support the retroactive application of Federal Law 12.651 / 2012. Offending the fence to the environmental setback and mitigating the tempus regit actum.
