Linguagem jurídica, o obstáculo para o entendimento

Abstract

Resumo: O presente trabalho foi desenvolvido na percepção da falta de entendimento da linguagem jurídica no atendimento a pessoa com baixo grau de instrução de escolaridade levando em consideração as condições de vida do indivíduo. O instrumento da linguagem utilizada de uma forma geral é insuficiente para que o cidadão tenha conhecimento dos direitos básicos garantidos pela Constituição da República Federativa do Brasil de 1988, direitos fundamentais, individuais e coletivos, causando a impressão de que, "todos somos iguais perante a lei" artigo equivocado onde a minoria privilegiada detém o conhecimento e outros sem oportunidade são considerados filhos da ignorância. O direito, ciência que se comunica com filosofia, sociologia, ética e política deveria ser o elemento da causa de evolução de um país e não causador de diferenças sociais, prejudicando a sociedade por uma carência de informações transmitidas por uma linguagem não esclarecedora a ponto de construir um muro na comunicação. Essas cometidas pela infelicidade de uma formação deficiente ou tratadas de maneira a intimidar o cidadão. Tendo em vista a dificuldade encontrada ao acesso às informações, vê-se a necessidade de introduzir métodos que possam facilitar a linguagem robusta utilizada por profissionais do ramo do direito, onde o resultado é o afastamento do direito primordial do ser humano, o conhecimento dos direitos básicos. Avalia-se, portanto os enigmas associados ao método das linguagens utilizadas por profissionais operadores do direito herdados do direito romano há séculos, ferindo o respeito ao próximo fazendo com que a pessoa se sinta em total constrangimento perante o locutor da informação prestada, sem direito ao manifesto das suas dúvidas por não compreender a atividade jurisdicional. Com a aplicação de questionário as pessoas que carecem de informações dos seus direitos e deveres, onde buscam soluções a seus conflitos de forma urgente, recorrendo a estudantes do curso de direito podemos medir o grau de compreensão de uma orientação jurídica realizada com pessoas cujo grau de instrução é precário e assim avalia-se a dificuldade encontrada no entendimento da linguagem jurídica. A conscientização do tema permitirá uma reflexão do tratado e causará transformações na abordagem e no tratamento no maior instrumento de um operador do direito, a palavra. A idealização de uma sociedade mais justa depende de todos, no saber ouvir, transmitir, respeitar e sermos pessoas mais humanizadas para com o próximo, o caminho para alcançarmos o real sucesso profissional e pessoal.

Abstract: This work was developed in the perception of a lack of understanding of legal language in serving people with low educational level of education taking into account the conditions of life of the individual.
