Abstract

Resumo: Esta tese analisa a evolução do Estado árabe moderno, destacando o papel do direito internacional em seu surgimento, declínio e possível transformação futura. Compara o desenvolvimento histórico do Estado na Europa com sua contraparte na região árabe, especialmente em relação ao surgimento do capitalismo e às influências do direito internacional. Examina criticamente a distorção estrutural do Estado árabe pelo direito internacional e seu vínculo com projetos imperialistas. Além disso, investiga as bases intelectuais e antropológicas do direito internacional e sua relação com a teoria do "outro", especulando sobre seu impacto futuro no Estado árabe e na própria existência do direito internacional. Por meio da análise das contradições internas e externas das estruturas sociais árabes e da lógica do direito internacional contemporâneo, a tese propõe hipóteses sobre as potenciais transformações políticas e jurídicas dos países árabes, cujas formas políticas alcançaram seus limites históricos

Abstract: This thesis analyzes the evolution of the modern Arab state, highlighting the role of international law in its emergence, decline and possible future transformation. Compares the historical development of the state in Europe with its counterpart in the Arab region, especially in relation to the emergence of capitalism and the influences of international law. Critically examines the structural distortion of the Arab State by international law and its link with imperialist projects. Furthermore, it investigates the intellectual and anthropological bases of international law and its relationship with the theory of the "other", speculating on its future impact on the Arab State and on the very existence of international law. Through the analysis of the internal and external contradictions of Arab social structures and the logic of contemporary international law, the thesis proposes hypotheses about the potential political and legal transformations of Arab countries, whose political forms have reached their historical limits
