Registro de imóveis no plano da eficácia : o registro como ato integrativo

Abstract

Resumo: Este trabalho tem como foco o estudo dos fatos integrativos, categoria que tem como um dos principais exemplos o ato de registro. Os atos registrais são tratados como atos de Direito Público que se integram aos atos registrados, afetando a sua eficácia. Diversos juristas tratam de elementos do suporte fático (Tatbestand, fattispecie, supuesto de hecho) dos fatos jurídicos, apontando elementos integrativos, que teriam os atos de registro como exemplo. Mas, ao mesmo tempo em que o registro é considerado elemento do suporte fático do ato registrado, ele é, em si mesmo, um ato jurídico diferente. São analisados os registros e os efeitos que eles produzem nos atos registrados, no intuito de compreender a relação entre os dois atos jurídicos. Para além do aprofundamento dos efeitos do Registro de Imóveis, a tese apresenta como elemento de novidade o estudo sistemático dos atos integrativos e do mecanismo da integração. Investiga-se, também, se os atos integrativos podem afetar a existência e a validade dos atos integrados, e não apenas os seus efeitos. Em suma, pesquisa-se o significado de ato integrativo, suas espécies e seus efeitos, aplicando-se tais ideias aos atos registrais do registro imobiliário.

Abstract: This doctoral dissertation focuses on the study of integrative facts, a category which has as one of its main examples the registration act. Registration acts are regarded as legal acts under Public Law that become integrated with the registered acts, thereby influencing their effects. Numerous legal scholars discuss the constituent elements of the factual basis (Tatbestand, fattispecie, supuesto de hecho) of legal facts, highlighting integrative elements, which would have registration acts as an illustrative example. However, while the registration act is considered a constituent element of the factual basis of the registered act, it is, in itself, a different legal act. Both the registries and the effects they generate within the registered acts are analyzed, in order to understand the relationship between the two legal acts. Beyond the indepth analysis of the effects of Real Estate Registration, this doctoral dissertation presents as a novelty element the systematic study of integrative acts and the mechanism of integration. It is also investigated whether integrative acts can affect the existence or the validity of another act, and not just their effects. In summary, this research delves into the meaning of integrative acts, their various manifestations, and their effects, all while applying these concepts to the registration acts of real estate registration.
