Adoção intuitu personae : a entrega direta como direito da mulher

Resumo: No ordenamento jurídico brasileiro, à mulher que decide entregar um filho biológico em adoção não é dado nenhum direito relacionado à escolha da família adotiva. Essa mulher tem direito a ser ouvida por equipe interdisciplinar no ato da entrega, mas não pode participar de nenhuma decisão sobre o futuro da criança, sendo, portanto, apagada e invisibilizada no processo de adoção. Esta situação decorre do paradigma do abandono, que penaliza a mulher que opta pela renúncia da maternidade, que seria uma vocação instintual, culturalmente forjada através do mito do amor materno. Todavia, as situações da vida demonstram que a decisão pela entrega é marcada por intensas subjetividades e ambivalências, sendo importante para a mulher que toma tal decisão ser não só ouvida, mas também considerada na colocação da criança em família substituta. Assim, é apresentado o direito à adoção intuitu personae motivada pela entrega direta da criança, pela mãe à família substituta, como decorrência da autonomia e da liberdade reprodutiva da mulher. São analisadas políticas públicas sobre liberdades reprodutivas no mundo, bem como as agendas de direitos humanos para a dignidade reprodutiva da mulher. Além disso, a adoção é, em si, tomada neste trabalho como um instituto que precisa ser informado por essas liberdades, afinal sua função, pela ótica da mulher, é de servir de meio para a desistência de uma parentalidade indesejada. Demonstra-se que a adoção não pode ser formulada como um caminho alternativo ao aborto ou ao "abandono", mas sim como política pública a considerar a autonomia da mulher para a entrega. As prerrogativas dadas a essa mulher devem contemplar o poder de decisão sobre a família que receberá seu filho biológico, bem como o direito de não ser apagada após a adoção. Para alcançar-se os objetivos do trabalho, fez-se uso de literatura jurídica relacionada à perspectiva de constitucionalização das relações privadas, bem como de literatura crítica com perspectiva de gênero, com enfoque em produção científica da antropologia jurídica nacional e internacional, além de terem sido considerados dados, estatísticas, normas, projetos de lei, opinativos, entendimentos jurisprudenciais e casos concretos, viabilizando uma compreensão complexa das subjetividades da mulher que entrega um filho em adoção, e da tutela atual e possível da entrega direta. Abstract: In Brazilian legal system, women who decide to give up a biological child for adoption don't have the right to choose the adoptive family. Theese women have only the right to be heard by an interdisciplinary team at the time of delivery, but they cannot participate in any decision about the child's future, being therefore deleted and made invisible in the adoption process. This situation stems from the abandonment paradigm, which penalizes the woman who chooses to give up motherhood, which would be an instinctual vocation, culturally forged through the myth of maternal love. However, life situations show that the decision to give birth is marked by intense subjectivities and ambivalences, and it is important for the woman who makes such a decision not only to be heard, but also to be considered when placing the child in a foster family. Thus, the right to "intuitu personae" adoption, wich is similar to a domestic adoption model, is presented in this theses, motivated by the direct delivery of the child, by the mother to the surrogate family, as a result of the woman's autonomy and reproductive freedom. Public policies on reproductive freedoms in the world are analyzed, as well as human rights agendas for women's reproductive dignity. In addition, adoption is, in itself, taken in this work as an institute that needs to be informed by these freedoms, after all its function, from the woman's perspective, is to serve as a means for giving up unwanted parenting. It demonstrates that adoption cannot be formulated as an alternative path to abortion or "abandonment", but rather as a public policy that considers the woman's autonomy for delivery. The prerogatives given to this woman must include decision-making power over the family that will receive her biological child, as well as the right os beeing presente in the life of her biological son after adoption. In order to achieve the objectives of the work, legal literature related to the perspective of constitutionalization of private relations was used, as well as critical literature with a gender perspective, with a focus on scientific production of national and international legal anthropology, in addition to having data, statistics, norms, bills, opinions, jurisprudential understandings and concrete cases were considered, enabling a complex understanding of the subjectivities of the woman who gives up a child in adoption, and the current and possible guardianship of direct delivery.
