    Abstract
Civil, art. 485, caput).

Abstract: The thesis for now sustained is that the supposed debtor doesn’t just have the embargoes against the execution to defend himself; these are just a - and the most efficient - of the actions that he can use for so much. Beside it, however, they cannot be him denied autonomous demands, able of being proposed before the beginning of the executive process, during its course or, mainly, after its closing; in special way in the hypotheses in that, if the process was of cognition, action would fit to annul ( "ação rescisória") the sentence (lato sensu) in it pronounced, because, not existing judgement in the own execution process, merit sentence that can be annulled ( "rescindida") doesn’t exist (Civil Process Code, art. 485, caput).
