Conceito pós-moderno de contrato : em busca de sua formulação na perspectiva civil-constitucional

Abstract

Resumo: A presente tese visa investigar o contrato das relações interprivadas numa perspectiva contemporânea. Para tanto, e por conta do esgotamento do sistema codificado de contrato, vigorante no Código Civil brasileiro, de 1916 (séc. XX), mas com todo o seu desenvolvimento teórico assentado no final do século XIX, recorrese à metodologia de constitucionalização do Direito Civil, fazendo-se a leitura deste ramo do Direito à luz da Carta Constitucional brasileira de 1988. O objetivo imediato da tese é a contribuição científica para a construção do conceito pós-modemo de contrato, a partir da metodologia eleita, com a finalidade imediata de reconhecimento dos variados perfis da contratação interprivada, neste final de século e início do século XXI, com exposição das perspectivas, dos fundamentos principiológicos e dos valores civis-constitucionais envolvidos, tendo em vista a definição contemporânea do instituto contratual. Assim, busca-se colher diretamente da Constituição os princípios e valores que fundamentam o contrato, atualmente, levando-se em conta a indispensável dedicação que a Carta Constitucional brasileira faz ao homem, neste trabalho, nomeado como sujeito titular de uma situação jurídica subjetiva. O desate da pergunta, a partir do título, assimilada ao longo do texto (qual o conceito contemporâneo de contrato?) encontra sua resposta no próprio ordenamento constitucional e no reconhecimento de que, hoje, concorrem em relevância e tutela jurídica, tanto os interesses patrimoniais quanto os existenciais do sujeito contratante.

Abstract: This thesis aims to investigate the contract in inter-private relationships from a contemporary perspective. To this purpose, and due to the exhaustion of the contract codified system in effect in the Brazilian Civil Code dating from 1916 (20th century), but with all its theoretical development established in the end of the 19th century, the constitutionalization methodology of the Civil Right is the preferred option, making a reading of this Law's branch at the light of the Brazilian Constitutional Charter from 1988. The immediate aim of this thesis is the scientific contribution to the construction of the post-modern concept of contract based on the selected methodology, with the immediate purpose of recognizing the diverse interprivate engagements profiles in this end of the century and beginning of the 21st century, exposing the involved perspectives, fundaments, and civil/constitutional values in view of the contemporary definition of contractual institution. Thus, the principles and values that lay the foundation for the contract nowadays are taken directly from the constitution, taking into account the indispensable dedication that, in this work, the Brazilian Constitutional Charter concedes to man, designated as titular subject of a subjective juridical situation. The untying of the question, since the title, which is assimilated through out the text (What is the contemporary concept for contract?), finds its answer in the constitutional arrangement itself, and in the recognition that, today, both patrimonial and personal Interests of the contracting subject contributes in relevance and juridical tutelage.
