Processo, espaços e acesso à justiça : uma análise das relações dos espaços do judiciário com a tutela de direitos e a tutela coletiva

Abstract

Resumo: A percepção de que o direito é influenciado por fatores extrajurídicos e recebe influxo da cultura na qual está inserido é o ponto de partida deste estudo. Assim, destaca-se que este trabalho pretende evidenciar uma manifestação específica, que, neste caso, é o espaço, compreendido sob a ótica da arquitetura. Trata-se de analisar como os locais que serviram de abrigo ao Judiciário, ao longo do tempo, influenciaram tanto no desenvolvimento do processo como na percepção dos cidadãos sobre a corte, sua imagem e suas funções. Ressalta-se que a compreensão dos espaços do judiciário não envolve apenas os locais físicos, mas também os digitais, vez que a tecnologia modificou profundamente as relações sociais e, consequentemente, os sistemas de resolução de litígios. Assim, há um enfoque especial na questão do acesso à justiça: deseja-se a ampliação da acessibilidade dos tribunais, maior participação social e aproximação entre cortes e sociedade. Nesse sentido, faz-se um recorte na tutela coletiva como instrumento central para a concretização dos ideais democráticos, mas que é ainda bastante subutilizada. Mais do que isso, há o questionamento de seu efetivo impacto em um sistema que ainda a utiliza sob a ótica individualista; isso inclui seus institutos, procedimentos e espaços em que se desenvolvem. Especificamente, há atenção nas possibilidades que as audiências públicas possuem para auxiliar na concretização das aspirações da tutela coletiva e os impactos que as escolhas dos espaços de sua realização podem ter em sua efetividade.

Abstract: The realization that the Law is influenced by non-legal elements and is deeply affected by the culture it is inserted is the basis of this research. It focuses on a specific form of expression that is the space in Architecture's perspective. There is an analysis on how the places used as frames for the Judiciary over time influenced both the development of the legal procedures as well as the perceptions of the citizens about the court, its image and its role. It must be highlighted that the spaces of the judiciary are not only the physical spaces, but also digital ones, since technology has profoundly changed social relations and, consequently, the dispute resolution systems. There is a special focus on the access to justice: the intention is to increase the accessibility of the courts and social participation, bringing the courts and society closer. Therefore, there is a spotlight on class actions, a fundamental instrument for the effectivity of the democratic ideals that is still underused in Brazil. Moreover, it is questioned the impact the class actions can have on a system that still approaches them from an individualist perspective; this includes their institutes, procedures and spaces in which they are held. Specifically, there is an attention to the possibilities that public hearings have to help accomplish the aspirations of the collective injunctions. As well as the impacts the spaces in which they are held can contribute to their effectiveness.
