Judicialização na educação infantil : uma análise da dinâmica do fenômeno no município de Curitiba

Abstract

Resumo: Esta dissertação insere-se no campo de estudos do fenômeno da judicialização da educação e teve por objetivo analisar a atuação do Tribunal de Justiça do Estado do Paraná frente ao movimento de judicialização da educação infantil no município de Curitiba, no período de 2015 a 2017, verificando se o Judiciário paranaense se configura um ator político nesse cenário. Para tanto, foram analisadas decisões proferidas pelo Tribunal em recursos de apelação e reexame necessário em ações que pleiteiam vaga em creche no município de Curitiba, consubstanciando-se uma pesquisa qualitativa pela análise documental de decisões judiciais e documentos correlatos. Da análise, constatou-se um curioso contrassenso do Tribunal na análise da disputa pela política educacional, uma vez que embora venha garantindo a efetividade de demandas individuais pela confirmação de sentenças favoráveis, em 98,4% das decisões analisadas, não sustenta essa postura em demandas coletivas. Isto porque além de restar pendente de julgamento pelo Tribunal uma ação civil pública proposta pelo Ministério Público estadual em 2014 que pleiteia a expansão da oferta de vagas em creche no município de Curitiba, ainda foi concedida, pelo próprio Tribunal, uma Suspensão de Liminares que suspende o efeito das decisões em ações individuais que concedem vaga em creche no município até que se tenha decisão definitiva. Um importante elemento, portanto, se evidenciou no município de Curitiba: as ações individuais que demandam por expansão da política educacional de oferta de vagas em creche se demonstra mais efetiva do que demanda coletiva com o mesmo propósito. Abstract: This dissertation studies the phenomenon of judicialization of education and aims to analyze the current actions of the Justice Court of Paraná in regards to the judicialization of basic education in the city of Curitiba between 2015 and 2017. This is performed by assessing whether the Judiciary of the state of Paraná has a political role in this scenario. In order to achieve this, we analyzed the decisions of the Court in appeals and reviews concerning lawsuits demanding for spots in nurseries in the city of Curitiba. The research was based on a qualitative analysis of judicial decisions and documents. The analysis shows an intriguing contradiction in the role of the Court in conflicts regarding educational policies because, despite ensuring the effectiveness of individual claims by deciding in favor of these claims - 98.4% of the decisions analyzed - the Court's decisions regarding collective demands do not follow this pattern. For, besides the lack of any decision by the Court regarding a civil lawsuit filed by the State Department of Public Prosecution in 2014 that calls for the expansion of the number of spots in nurseries in the city of Curitiba, the same Court made void any injunctions related to individual lawsuits for spots in nurseries until a final decision is made. Therefore, the city of Curitiba witnessed an important element: the fact that individual lawsuits that demand the expansion of the educational policy of spots in nurseries are more effective than collective demands with the same purpose.
