    Abstract
Palavras-chave: fontes do Direito; precedentes judiciais obrigatórios; garantias processuais constitucionais.

Abstract: The present doctoral thesis analyzes the necessary adjustments with a view to adopting a system of binding precedents in Brazil, reconciling it with the due process guarantees the Brazilian Federal Constitution foresees. First and foremost, we propose a concept of ratio decidendi, which we understand is compatible with the civil law tradition, taking into account the absence of a Brazilian tradition in the analysis and handling of judicial precedent. For the adoption of a system of stare decisis in Brazil - aimed at bringing the Rule of Law into life by assigning more weight to consistent judicial approach to materially similar cases, hence guaranteeing legal security and predictability of judicial decisions - we propose the adoption of a system of binding precedents; said system would (i) operate in light of the guarantees offered by the principles: audi alteram partem, broad right to defense, and the obligation to provide reasoned decisions; and (ii) have as a premise the acknowledgement that audi alteram partem and broad right to defense must be understood as the right to influence the construction of the judicial decision, and that the obligation to provide reasoned decisions must be understood as the obligation to debate. Finally, we set out to demonstrate how the adoption of procedural techniques, such as the Brazilian binding abridgments and the Brazilian procedure for trial of repetitive special and extraordinary appeals cannot be confused with the adoption of a system of binding precedents. Keywords: sources of the Law; binding precedent; constitutional procedural guarantees.
