    Educação em direitos humanos com perspectiva antidiscriminatória : diálogos entre estudos autistas e LGBTI+ sobre barreiras atitudinais aos direitos da personalidade

    Resumo: O tema desta tese é a análise da educação em direitos humanos (EDH) como um instrumento de combate à discriminação, a partir de diálogos entre estudos autistas e LGBTI+ sobre as barreiras atitudinais aos direitos da personalidade, produzidas por processos de estigmatização social. Trata-se de um estudo teórico, realizado por meio de pesquisa qualitativa e exploratória, com a utilização de método dedutivo e técnicas de pesquisa bibliográfica e documental. Entre os direitos pertinentes a esta análise, estão os direitos à identidade, vida digna, autodeterminação, livre desenvolvimento e expressão da personalidade e integridade física, psíquica e moral. As discussões teóricas acerca desses direitos perpassam não apenas sua abordagem como direitos da personalidade (na esfera civil), mas também como direitos fundamentais (na esfera constitucional) e como direitos humanos (na esfera das convenções internacionais). Entre as bases de tais direitos, estão os princípios jurídicos da igualdade e da não discriminação, ambos transversais às referidas esferas, que podem ser interligadas pelos enfoques da constitucionalização e da convencionalização do direito civil. A fim de analisar os atravessamentos entre autistofobia e lgbtifobia, no contexto de um sistema de opressões interconectadas, um dos pontos discutidos pela tese é a prática de incitação às tentativas de correção, cura ou conversão, entendida como uma das formas de violação dos direitos da personalidade, que poderiam ser combatidas pela desestigmatização social promovida por ações de EDH apoiadas por uma perspectiva antidiscriminatória. Como resultado, a tese desenvolve uma proposta de guia para tais ações. A ideia para essa proposta se baseia no Programa Nacional de Educação em Direitos Humanos e Cidadania, que foi instituído em 2025 pelo Ministério dos Direitos Humanos e da Cidadania. Alguns dos objetivos desse programa são a formação de profissionais e a oferta de cursos virtuais e materiais educativos digitais, tendo como público-alvo lideranças sociais, estudantes, educadoras, servidoras, gestoras públicas e demais interessadas na promoção e defesa dos direitos humanos. Portanto, a tese apresenta a Proposta de "Guia Autista e LGBTI+ de Estima Antiestigma" (GALEA), nome criado pelo autor para ser referido como feminino. Tal guia se dirige a ações de EDH contra a discriminação de autistas e LGBTI+, com um planejamento feito em colaboração entre governo, meio acadêmico e sociedade, incluindo a participação de autistas e LGBTI+, em uma coprodução do conhecimento sobre as estratégias para a remoção das barreiras atitudinais aos direitos da personalidade. Pensada para ações fora do escopo da educação formal, os grupos preferenciais indicados como públicoalvo dessas ações seriam pessoas que se identifiquem (convivam com, trabalhem no cuidado de, ou estudem sobre) autistas, LGBTI+ e autistas LGBTI+, com foco principal (porém não exclusivo) em pessoas adultas e pessoas idosas. Entre outros fatores, a escolha desse recorte etário responde a uma frequência menor de iniciativas voltadas aos direitos de autistas que não sejam crianças e adolescentes, bem como a uma frequência maior de ataques às iniciativas voltadas aos direitos de LGBTI+ na infância e na adolescência. Além da GALEA, a tese faz a proposta de dois novos conceitos, como chaves de leitura para a interpretação de estudos sobre direitos, relacionados à noção de estima social e à noção de pertencimento social como fatores de proteção e afirmação de direitos humanos diante das barreiras atitudinais. O primeiro conceito é o de hargemonia e o segundo, dele derivado, é o conceito de grupos hargemônicos
     
    Abstract: The theme of this doctoral thesis (or doctoral dissertation, as it is called in some parts of the world) is the analysis of human rights education (HRE) as an instrument to combat discrimination, based on dialogues between autistic and LGBTI+ studies on attitudinal barriers to personality rights, produced by processes of social stigmatization. This is a theoretical study, conducted through qualitative and exploratory research, using a deductive method and bibliographic and documentary research techniques. Among the rights relevant to this analysis are the rights to physical, psychological, and moral integrity, free development and expression of personality, self-determination, identity, and a dignified life. The theoretical discussions about these rights encompass not only their approach as personality rights (in the civil sphere), but also as fundamental rights (in the constitutional sphere), and as human rights (in the sphere of international conventions). At the base of these rights are the legal principles of equality and non-discrimination, both transversal to the aforementioned legal spheres, which can be interconnected by the approaches of constitutionalization and conventionalization of civil law. In order to analyze the intersections between autisticphobia and lgbtiphobia, within the context of a system of interconnected oppressions, one of the points discussed by the thesis is the practice of inciting attempts at correction, cure, or conversion, understood as one of the forms of violation of personality rights that could be combated by the social destigmatization promoted by HRE actions supported by an anti-discriminatory perspective. As a result, the thesis develops a proposal of guide for such actions. The idea for this proposal is based on the National Program for Education in Human Rights and Citizenship, established in 2025 by the Ministry of Human Rights and Citizenship. Some of the program's objectives are the training of professionals and the offering of virtual courses and digital educational materials, targeting social leaders, students, educators, public servants, public managers, and others interested in the promotion and defense of human rights Therefore, the thesis presents the Proposal of an "Autistic and LGBTI+ Guide to AntiStigma Esteem" (GALEA), a name created by the author to be referred to as feminine. It is a guide for HRE actions to combat discrimination against autistic and LGBTI+ individuals, with planning done collaboratively between government, academia, and society, including the participation of autistic and LGBTI+ individuals in a co-production of knowledge about strategies for removing attitudinal barriers to personality rights. Designed for actions outside the scope of formal education, the preferred groups indicated as the target audience for these actions would be people who identify as (or live with, work in the care of, or study about) autistic, LGBTI+, and autistic LGBTI+ individuals, with a primary (but not exclusive) focus on adults and elderly people. Among other factors, the choice of this age range responds to a lower frequency of initiatives focused on the rights of autistic individuals who are not children and adolescents, as well as a higher frequency of attacks on initiatives focused on LGBTI+ rights in childhood and adolescence. In addition to GALEA, the thesis proposes two new concepts as keys to the interpretation of the studies on rights, related to the notion of social esteem and the notion of social belonging as factors in protecting and affirming human rights in the face of attitudinal barriers. The first concept is hargemony, and the second, derived from it, is the concept of hargemonic groups
