O "humano" e os direitos : estratégias em conflito no enquadramento dos dirietos de pessoas LGBTI+ no Brasil contemporâneo

Resumo: O presente trabalho parte da problemática da distribuição desigual dos direitos humanos e fundamentais, mesmo em contextos nos quais sua realização seja supostamente assumida como objetivo central do ordenamento jurídico. Parte, ademais, da percepção de que os problemas de efetivação não se resumem à desvios acidentais dos direitos humanos, mas parecem possuir, a julgar por sua história, uma relação mais complexa e constitutiva com estes. Assim, perguntar-se pela distribuição desigual dos direitos humanos e fundamentais aponta para a necessidade de perguntar-se acerca das formas de fundamentação e concepção desses direitos, abarcando os processos que os constituem como tais, bem como seus efeitos produtivos. Selecionando como foco central da análise certos processos em que se visualiza a construção dos direitos humanos e fundamentais de pessoas LGBTI+ no Brasil contemporâneo a partir de uma perspectiva civil-constitucional, esta tese investiga essas problemáticas. Através da análise empírica das manifestações de sociedade civil, autoridades e Corte nas ADI 4277/ADPF 132 e na ADI 5668, conjuntamente ao Acórdão da ADPF 457, todas do Supremo Tribunal Federal, procura delinear as maneiras através das quais os direitos humanos emergem nessa disputa, com os diferentes atores envolvidos buscando (des)constituir uma determinada população como destinatária de determinados direitos. Através da análise desses materiais, sinaliza o quanto a "humanidade" e/ou "cidadania" dos próprios destinatários desses direitos é muitas vezes colocada em questão nos conflitos, enquanto grupos "favoráveis" se esforçam em encaixá-los nas representações culturalmente disponíveis acerca do "humano" e do "cidadão" adequado e pleno, e grupos "contrários" buscam qualificá-los como excluídos desses contornos e, com frequência, como ameaças à estabilidade da própria "natureza humana". A tese toma, assim, um material empírico bastante rico, trazendo as vozes de atores com diferentes posições sobre o tema, realizando uma análise de tipo qualitativa com vistas a compreender as estratégias mobilizadas nessas disputas por direitos. A partir daí e com inspiração ensaísta, procura então desenvolver os problemas estratégicos e teóricos dali surgidos, resultando em um questionamento sobre as formas de fundamentação dos direitos humanos e fundamentais. Nesse caminho, a "família" heterossexual revela-se como categoria chave de compreensão dos modelos socialmente hegemônicos de "humano" e "cidadão", especialmente quando estão em jogo os direitos de pessoas LGBTI+. Refletir sobre essa posicionalidade da "família" como condicionadora do status de membro pleno da comunidade política permitirá também, a proposição de certas contribuições na compreensão desse instituto, visando sua realização numa ótica contemporânea e democrática. Trata-se, de forma geral, de um trabalho localizado em uma "encruzilhada", a partir do entrelaçamento de olhares estratégicos e teóricos, além de profundamente transdisciplinares. As contribuições alcançadas por essa tese indicam a necessidade de evidenciação do atravessamento, por concepções culturais restritas e excludentes acerca do "humano" e do "cidadão", das normas que conhecemos por "direitos" e que de diferentes formas se relacionam com os suportes sociais que garantem a continuidade da vida humana. Procura-se, enfim, a partir de uma compreensão contingente dos "direitos humanos e fundamentais", refletir sobre suas formas de constituição, operacionalização e fundamentação, com vistas a modificar as realidades contemporâneas de sua distribuição desigual. Abstract: The present work starts from the problematic of the unequal distribution of human and fundamental rights, even in contexts in which their realization is supposedly assumed as the central objective of the legal system. It starts, moreover, from the perception that the problems of implementation are not limited to accidental deviations from human rights, but seem to have, judging by their history, a more complex and constitutive relationship with them. Thus, asking about the unequal distribution of human and fundamental rights points to the need to ask about the forms of foundation and conception of these rights, encompassing their conditions of historical emergence, as well as their productive effects. Selecting as the central focus of the analysis the construction of human and fundamental rights of LGBTI+ people in contemporary Brazil from a civil-constitutional perspective, this thesis investigates these issues. Through the empirical analysis of the manifestations of civil society, authorities and the Court in ADI 4277/ADPF 132 and ADI 5668, together with the decision of ADPF 457, all of the Federal Supreme Court, it seeks to outline the ways in which human rights emerge in this dispute, with the different actors involved seeking to (de)constitute a certain population as recipients of certain rights. Through the analysis of these materials, it shows how much the "humanity" and/or "citizenship" of the recipients of these rights is often called into question in conflicts, while "favorable" groups strive to fit them into culturally available representations about the adequate "human" and "citizen", and "contrary" groups seek to qualify them as excluded from these contours and, frequently, as threats to the stability of "human nature" itself. Thus, the thesis takes a very rich empirical material, bringing the voices of actors with different positions on the subject, carrying out a qualitative analysis with a view to understanding the strategies mobilized in these disputes for rights. From there, and with essayist inspiration, it seeks to develop the strategic and theoretical problems that arose from there, resulting in a questioning of the ways in which human and fundamental rights are based. In this way, the heterosexual "family" reveals itself as a key category for understanding the socially hegemonic models of "human" and "citizen", especially when the rights of LGBTI+ people are at stake. Reflecting on this positionality of the "family" as a condition of the status of full member of the political community will also allow the proposition of certain contributions to the understanding of this institute, aiming at its realization in a contemporary and democratic perspective. It is, in general, a work located at a "crossroads", based on the intertwining of strategic and theoretical, as well as deeply transdisciplinary views. The contributions achieved by this thesis indicate the need for evidence the crossing, by restricted and excluding cultural conceptions about the "human" and the "citizen", of the norms we know as "rights" and that in different ways relate to social supports that guarantee the continuity of human life. Finally, from a contingent and postfoundational understanding of "human and fundamental rights", it seeks to reflect on their forms of constitution, operationalization and foundation, with a view to modifying the contemporary realities of their unequal distribution.
