Um contra-arquétipo para a educaçao jurídica : a proposta de criaçao de um núcleo transdisciplinar

Abstract

Resumo: Esta pesquisa trata do estudo de uma ação contra o arquétipo formulado nas práxis de ensino dos cursos jurídicos no Brasil, com embasamento na teoria do insconciente coletivo de Carl Gustav Jung. O legado dessa teoria permite que novas frentes sejam abertas a partir de suas constatações científicas criadas na materialização dos arquétipos. Por arquétipo entendem-se aqueles padrões de comportamento repetidamente formulados no meio social, de maneira regular e uniforme, cuja base de existência está no inconsciente coletivo. A proposta da pesquisa é demonstrar, por meio das revisão bibliográfica realizada, evidências da maneira como esse arquétipo se cristalizou no decorrer da história do ensino jurídico e, daí, observar seus efeitos nocivos resultantes, verificados no distanciamento do ensino das demandas sociais. Na constatação de seus efeitos surge a possibilidade da criação, com base no pensamento de Jung e nos demais marcos teóricos, de uma resposta terapêutica capaz de produzir resultados inovadores, pela implantação de uma nova estrutura sociopedagógica nos cursos jurídicos. A essa hipotética reposta terapêutica dá-se o nome de contra-arquétipo, caracterizado em seu centro como um contradiscurso capaz de produzir efeitos dissonantes daqueles atualmente produzidos pelo modelo tradicional. Para tal desenvolvimento, metodologicamente é estabelecida uma estruturação coerente com os marcos teóricos adotados, capaz de, experimentalmente, romper com os postulados epistemológicos da ciência moderna, visando reconhecer o surgimento de um novo paradigma científico emergente, de bases transdisciplinares e emancipatórias. O método principal é a dedução, efetivado por meio de silogismos e polissilogismos, construídos a partir da revisão bibliográfica. A validação do conhecimento científico produzido foi obtida com base na avaliação de sua capacidade emancipatória perante as comunidades envolvidas na sua aplicação. O contéudo da tese foi desenvolvido em três capítulos, sendo o primeiro destinado à construção das evidências de comprovação da existência do arquétipo, o segundo à construção de premissas de transformação para embasamento das ações contra o arquétipo e o terceiro à estruturação e defesa da resposta à problematização apresentada, dentro da perspectiva de implantação da educação jurídica no Brasil.

Abstract: This research is about an action against the archetype formulated in the teaching praxis of juridical courses in Brazil based on Carl Gustav Jung's theory of collective unconscious. The legacy of Jung's theory allows new fronts to be open from his scientific verifications created from materialization of the collective unconscious in the form of archetypes. Archetypes are those patterns of behavior repeatedly formulated in the social environment , in a regular and uniform way, whose existence is in the collective unconscious. The proposal of this research is to demonstrate, through the bibliographical revision carried out, evidences in the way such an archetype crystallized along the juridical teaching history, and then to observe its resulting harmful effects, verified in the gap between such teaching and social demands. In the verification of its effects, based on Jung's thoughts and other theoretical landmarks, the possibility of the creation of a therapeutic response capable of producing innovative results appears through the implementation of a new social-pedagogic structure in the juridical courses. Such a hypothetical therapeutic response is called counterarchetype, characterized in its center as a counter-speech capable of producing dissonant effects from those currently produced by the traditional model. For such development, a coherent structuring is methodologically established with the adopted theoretical landmark, capable of breaking experimentally with the epystemologic postulates of modem science, in favor of recognizing the arousal of a new emergent scientific paradigm, with transdisciplinary and emancipatory basis. The source of this method is the deduction, achieved through syllogisms and polissyllogisms built from the bibliographical revision carried out, whose validation of the produced scientific knowledge is obtained from the evaluation of its emancipatory capacity before the communities involved in its application. The content of the thesis has been developed in three chapters. The first one is destined for the construction of the evidence to prove the existence of the archetype; the second one is destined for the construction of transformation premises to base the actions against the archetype; and the third one, for the structuring and defense of the response to the presented issue, inside the perspective of the implementation of the new juridical education in Brazil.
