    A inconstitucionalidade da vedação de conversão de tempo especial em tempo comum

    Abstract
    Resumo: O acesso a critérios diferenciados para alcançar um benefício de aposentadoria é constitucionalmente garantido para os trabalhadores que exercem atividades nocivas à saúde. Entretanto, a Emenda Constitucional nº 103/19 vedou expressamente a possibilidade de conversão de tempo especial em tempo comum a partir de 13/11/2019. Portanto, defende-se neste artigo que a alteração instituída pela EC 103/19 é inconstitucional. Para tanto, é necessário caracterizar a Seguridade Social como direito fundamental social dotado de normatividade material; realizar um histórico legislativo do direito à conversão do tempo especial em tempo comum; fundamentar a inconstitucionalidade de Emendas Constitucionais e argumentar a inconstitucionalidade da vedação de conversão de tempo especial em tempo comum.
     
    Abstract: The access to differentiated criteria to achieve a retirement benefit is constitutionally guaranteed for workers who perform activities that are harmful to health However, Constitutional Amendment nº 103/19 expressly prohibited the possibility of converting special time into ordinary time after 13/11/2019. Therefore, it is defended in this article that the change instituted by EC 103/2019 is unconstitutional. So, it is necessary to characterize Social Security as a fundamental social right endowed with material normativity; make a legislative history of the right to convert special time into ordinary time; justify the unconstitutionality of constitucional amendments and, finally, to argue the unconstitutionality of the prohibition of conversion of special time into ordinary time promoted by the Social Security Reform
