Direito, cidadania sacrificial e o homo oeconomicus : a razão neoliberal norteadora das reformas trabalhista e previdenciária

Abstract

Resumo: A presente dissertação tematiza as reformas trabalhista (Lei n° 13.467/2017) e previdenciária (Emenda Constitucional n° 103/2019) à luz dos conceitos de cidadania sacrificial e desdemocratização. Enquanto referencial teórico principal, a pesquisa se amparou nas reflexões da cientista política Wendy Brown, a qual compreende o neoliberalismo como um fenômeno que atenta contra os princípios basilares das democracias modernas. Enquanto objetivo geral, a investigação se propôs a assimilar como as reformas trabalhista e previdenciária foram desenhadas a partir da racionalidade neoliberal, a qual fez emergir uma cidadania singular – a sacrificial – que despoja o sujeito de prerrogativas jurídicas sociais para nivelá-lo à hecatombe da razão neoliberal, tornando-o capital humano de si mesmo, mas também o vinculando a um compromisso para com o bem-estar da sociedade em geral, o que justifica um sacrifício não recompensado. Concluiu-se que as reformas trabalhista e previdenciária compõem uma estratégia em curso de despolitização da cidadania constitucional – retirando direitos e naturalizando o discurso economicista – com a finalidade de desamarrar o capital, tanto vulnerabilizando o trabalhador (levado a se atracar no jogo concorrencial) e reduzindo os custos do empregador, quanto desonerando o Estado de seu dever para com a seguridade social, visto que, agora, a ação governamental está sob a avaliação da economia neoliberal (Estado empresa)

Abstract: This dissertation thematizes the labor (Law n° 13.467/2017) and social security (Constitutional Amendment n° 103/2019) reforms in the light of the concepts of sacrificial citizenship and dedemocratization. As the main theoretical framework, the research was based on the reflections of political scientist Wendy Brown, who understands neoliberalism as a phenomenon that undermines the basic principles of modern democracies. As a general objective, the investigation proposed to assimilate how the labor and social security reforms were designed from the neoliberal rationality, which gave rise to a singular citizenship – the sacrificial one – that strips the subject of social legal prerogatives to level him to the hecatomb of neoliberal reason, making him human capital of himself, but also linking him to a commitment to the well-being of society in general, that justifies an unrewarded sacrifice. It is concluded that the labor and social security reforms are part of an ongoing strategy of depoliticization of constitutional citizenship – removing rights and naturalizing the economistic discourse – with the purpose of untying capital, both by making the worker vulnerable (led to engage in the competitive game) and reducing the employer's costs, and by relieving the State of its duty to social security, since now government action is under the evaluation of neoliberal economics (State company)
