O paradoxo das ilegalidades no processo penal : a dinâmica entre abordagens policiais e a resposta judicial

Abstract

Resumo: Este artigo analisa o paradoxo existente entre as ilegalidades cometidas pela polícia na fase inicial do processo penal e a subsequente validação dessas irregularidades pelo Judiciário. Partindo de casos específicos e de uma revisão jurisprudencial, evidencia-se como práticas abusivas são frequentemente legitimadas na audiência de custódia, ora por um viés punitivista, ora pela sobrecarga de demandas. O estudo demonstra que tal dinâmica gera uma retroalimentação negativa: de um lado, a polícia age com confiança de que suas falhas processuais serão raramente questionadas; de outro, o Judiciário, ao validar abordagens irregulares, reforça práticas que violam direitos fundamentais. Conclui-se que uma reformulação na análise das Ilegalidades é essencial para garantir um processo justo e para conter práticas abusivas que comprometem a legitimidade da justiça penal

Abstract: This article examines the paradox between procedural illegalities committed by the police during the initial phase of criminal procedures and the subsequent judicial validation of these irregularities. Drawing on specific cases and jurisprudential analysis, the study reveals how abusive practices are often legitimized in custody hearings, driven either by a punitive bias or by the excessive workload of the courts. This dynamic creates a negative feedback loop: on one hand, the police act with confidence that procedural errors will seldom be questioned; on the other, the judiciary reinforces such practices by validating irregular actions, infringing upon fundamental rights. The article concludes that reforming the analysis of procedural illegalities is essential to ensuring fair processes and curbing abusive practices that undermine the legitimacy of criminal justice
