Violência de gênero e a legislação brasileira

Abstract

Resumo: Violência de gênero não ocorre somente no relacionamento amoroso, mas também em abusos em família, em ambientes de trabalho e entre amigos, sempre que houver qualquer tipo de abuso de poder, causando traumas difíceis de superar nas vítimas. Neste estudo consta a evolução da legislação brasileira com análise de itens determinantes, no âmbito do combate à violência de gênero; assim como os direitos da mulher ao longo da história. A norma constitucional que estabelece que todos são iguais perante a lei, não condiz com a realidade social brasileira. A legislação está proporcionando uma realidade juridicamente melhor, mas longe de ser a ideal. A Lei Maria da Penha, trouxe inovações excelentes, tanto que é considerada uma das três melhores leis do mundo no enfrentamento da violência de gênero

Abstract: A gender-based violence does not only occur in romantic relationships, but also in family abuse, at workplaces and in friendships, whenever there is any type of power abuse, causing traumas that are painful to overcome. This study includes the evolution of Brazilian legislation with the analysis of determining factors in fight against gender violence; as well as women's rights throughout history. The constitutional rule that everyone is equal before the law is not in line with Brazilian social reality. Legislation is providing a better legal reality, but it is far from ideal. The Maria da Penha Law brought outstanding innovations, so much so that it is considered one of the three best laws in the world for facing gender-based violence
