Controle preventivo de constitucionalidade : análise da efetividade da atuação da Comissão de Constituição e Justiça da Câmara Municipal de Curitiba no biênio 2022 - 2023

Abstract

Resumo: O controle preventivo de constitucionalidade é uma função de enorme importância para os membros do Poder Legislativo, embora muitas vezes seja desvalorizado se comparado ao controle repressivo do Judiciário. Na Câmara Municipal de Curitiba, a Comissão de Constituição e Justiça (CCJ) é responsável pela análise de constitucionalidade, legalidade, regimentalidade e juridicidade dos projetos de lei. Entretanto, é evidente que tal análise pode ser influenciada por considerações políticas e ideológicas dos seus membros, constituindo um desvio do controle preventivo, que deve ser pautado por critérios técnicos. Para tanto, a fim de verificar a efetividade do controle preventivo de constitucionalidade realizado pela CCJ da Câmara dos Vereadores de Curitiba, este trabalho firmou-se na metodologia de Índice de Análise de Constitucionalidade (IAC), desenvolvida por João Trindade Cavalcante Filho em sua Tese de Doutorado, a fim de traçar uma pontuação para a o controle realizado, de -1 a 1, a depender da efetividade da análise. Assim, para a aplicação desse método no âmbito legislativo de Curitiba, foram analisados os pareceres de 213 projetos de lei ordinárias, complementares e de resolução distribuídos para a CCJ nos anos de 2022 e 2023. Os resultados mostraram que o colegiado de 2022, composto majoritariamente por juristas, teve uma média IAC de 0,56, indicando maior efetividade, enquanto o colegiado de 2023, com menos juristas, teve uma média IAC de 0,46. No geral, a atuação da CCJ da Câmara Municipal de Curitiba apresentou-se parcialmente efetiva, conforme classificação de João Trindade, no controle preventivo de constitucionalidade, com uma média IAC do biênio de 0,511

Abstract: Preventive control of constitutionality is a function of enormous importance for members of the Legislative Branch, although it is often undervalued compared to the repressive control of the Judiciary. At the Curitiba City Council, the Constitution and Justice Commission (CCJ) is responsible for analyzing the constitutionality, legality, regimentation and legality of bills. However, it is clear that such analysis can be influenced by political and ideological considerations of its members, constituting a deviation from preventive control, which must be guided by technical criteria. To this end, in order to verify the effectiveness of the preventive control of constitutionality carried out by the CCJ of the Chamber of Councilors of Curitiba, this work was based on the Constitutionality Analysis Index (IAC) methodology, developed by João Trindade Cavalcante Filho in his Thesis of Doctorate, in order to establish a score for the control carried out, from -1 to 1, depending on the effectiveness of the analysis.
