A ineficácia do combate ao trabalho escravo contemporâneo no Brasil do século XXI : análise de um problema sistêmico

Abstract

Resumo: O presente artigo aborda o fenômeno denominado de "escravidão contemporânea" no âmbito do Brasil, seguindo prioritariamente o conceito expresso pelos elementos contidos no tipo penal do artigo 149 do Código Penal; especificamente em relação à sua persistência, a qual revela a aparente ineficácia do sistema de combate à escravidão contemporânea atualmente observado em âmbito nacional, com a intenção de identificar as principais causas de tal ineficácia. A metodologia da pesquisa caracteriza-se como do tipo indutiva com abordagem quantitativa/qualitativa. Para o propósito de cumprir a finalidade pretendida, foi realizada análise bibliográfica da literatura doutrinária referente ao tema da escravidão contemporânea, complementada por eventual análise jurisprudencial e análise documental sobre documentos oficiais relevantes, divulgados pelo governo brasileiro e pela Organização Internacional do Trabalho, visando principalmente a coleta de dados pertinentes ao tema. A partir da análise de tais materiais, foram analisadas as tendências da escravidão contemporânea em cenário global e nacional; da persistência de tal fenômeno no âmbito do Brasil, buscando identificar suas possíveis causas; e de dados empíricos que evidenciam a relativa impunidade aproveitada por empregadores que utilizam-se de trabalho escravo contemporâneo. Os resultados da pesquisa permitem a conclusão de que a aparente ineficácia no combate à escravidão contemporânea no âmbito do Brasil resulta, em sua origem, de uma falta de vontade política dos agentes que realizam tal combate, profundamente ligada à influência que o desenvolvimento do capitalismo no Brasil teve sobre a formação de suas diversas instituições

Abstract: This article approaches the subject of the phenomenon named as "modern slavery" within the scope of Brazil, primarily following the concept expressed by the elements contained in the criminal type of article 149 of the Brazilian Penal Code; specifically in relation to its persistence, which reveals the apparent inefficacy of the system for combatting modern slavery currently observed nationwide, with the intention of identifying the principal causes of such inefficacy. The methodology of this research is characterized as being of the inductive type with a quantitative/qualitative approach. For the purposes of fulfilling the intended purpose, a bibliographical analysis was realized over the literature of legal doctrine pertaining to the subject of modern slavery, complemented by eventual case law analysis and documental analysis over relevant official documents, published by the Brazilian government and by the International Labour Organization, seeking mainly the collection of data pertinent to the subject. From the analysis of such materials followed the analysis of the tendencies of modern slavery in a global and national scenery; of the persistence of such a phenomenon within the scope of Brazil, seeking to identify its possible causes; and of empirical data that evidenced the relative impunity enjoyed by employers that utilize modern slave labor. The results of this research allow for the conclusion that the apparent inefficacy in the combat against modern slavery within the scope of Brazil results, in its origins, from a lack of political will from the agents that perform such combat, profoundly linked to the influence that the development of capitalism in Brazil had over the formation of its various institutions
