Resumo: O objeto deste estudo é a análise cronológica dos inquéritos e processos judiciais incidentes nos art. 156, 157 e 158 do Código Penal de 1890 e nos arts. 283 e 284 do Código Penal de 1940, ainda vigente. Far-se-á uma análise dos processos e inquéritos judiciais desde o ano 1890 à 1941, realizando um levantamento dos principais argumentos utilizados, correlacionando-os, doutrinariamente, com os fatores sociais que levaram ao início de tais processos.Abstract: The object of this study is the chronological analysis of the investigations and legal proceedings incident to art. 156, 157 and 158 of the Criminal Code of 1890 and in arts. 283 and 284 of the 1940 Penal Code, still in force. An analysis will be made of judicial processes and inquiries from 1890 to 1941, making a survey of the main arguments used, correlating them, doctrinally, with the social factors that led to the beginning of such processes
