Sistema prisional feminino brasileiro e o acesso ao direito à saúde : uma correlação entre as regras de Bangkok e a constituição federal de 1988

Abstract

Resumo: Este trabalho analisa o sistema prisional feminino brasileiro sob a perspectiva do acesso ao direito à saúde, correlacionando as diretrizes das Regras de Bangkok com os direitos fundamentais previstos na Constituição Federal de 1988. O artigo busca destacar como as Regras de Bangkok reafirmam direitos já assegurados pelo texto constitucional, mas frequentemente negligenciados na prática devido à discriminação de gênero estrutural e à inadequação das políticas públicas ao contexto feminino no encarceramento. Abordando as vulnerabilidades específicas das mulheres encarceradas, como a precariedade das condições de saúde e higiene, a maternidade em contexto prisional, o isolamento social, a estigmatização e a violência de gênero, argumenta-se que o sistema prisional brasileiro, historicamente projetado para homens, não atende às demandas específicas das mulheres, agravando desigualdades estruturais e perpetuando ciclos de exclusão social. A análise destaca a importância de integrar as diretrizes das Regras de Bangkok aos direitos constitucionais, utilizando uma abordagem de metodologia qualitativa que teve como base principal o estudo de regras presentes das Regras de Bangkok e também de direitos constitucionais, além de basear-se em um uso estratégico da ferramenta ChatGPT para a identificação e exploração doa marcos teóricos e ideias aplicadas no trabalho. A implementação de políticas eficazes, sensíveis às particularidades do encarceramento feminino, é apontada como essencial para transformar o sistema prisional em um espaço que promova a reinserção social e respeite os direitos humanos

Abstract: This paper analyzes the Brazilian female prison system from the perspective of access to the right to health, correlating the guidelines of the Bangkok Rules with the fundamental rights established in the Federal Constitution of 1988. The article seeks to highlight how the Bangkok Rules reaffirm rights already guaranteed by the constitutional text but are often neglected in practice due to structural gender discrimination and the inadequacy of public policies to address the specific context of female incarceration. By addressing the specific vulnerabilities of incarcerated women—such as precarious health and hygiene conditions, motherhood in prison, social isolation, stigmatization, and gender-based violence—the study argues that the Brazilian prison system, historically designed for men, fails to meet women’s specific needs, exacerbating structural inequalities and perpetuating cycles of social exclusion. The analysis underscores the importance of integrating the Bangkok Rules' guidelines with constitutional rights, using a qualitative methodology approach that was mainly based on the study of rules present in the Bangkok Rules and also constitutional rights, in addition to being based on a strategic use of the ChatGPT tool for the identification and exploration of theoretical frameworks and ideas applied in the work. The implementation of effective public policies, sensitive to the particularities of female incarceration, is identified as essential for transforming the prison system into a space that fosters social reintegration and respects human rights
