As estratégias de litigância da comunidade quilombola Invernada Paiol de Telha na busca por seus direitos sociais e territoriais

Abstract

Resumo: Este estudo de caso teve como objetivo analisar a luta pela demarcação e titulação das terras da Comunidade Quilombola Invernada Paiol de Telha, localizada no município de Reserva do Iguaçu, no estado do Paraná, bem como os conflitos socioambientais e fundiários relacionados à Comunidade, sob a ótica da litigância estratégica. O objetivo central da pesquisa foi avaliar e relatar o histórico de luta e desapropriação territorial da Comunidade, bem como o andamento e os desdobramentos do processo administrativo de demarcação da comunidade junto ao INCRA, e os diversos conflitos políticos e jurídicos decorrentes da situação fática e jurídica da Comunidade. A metodologia utilizada foi o estudo de caso qualitativo, a partir da análise documental do processo administrativo de demarcação e titulação de terras em trâmite no INCRA em relação à Comunidade Quilombola Invernada Paiol de Telha, bem como dos processos judiciais relativos aos direitos territoriais dos membros da Comunidade - além de trabalhos acadêmicos produzidos sobre a situação da Comunidade, bem como das comunidades quilombolas em geral. Além disso, foi realizado trabalho de campo por meio de entrevistas semi-estruturadas com membros da Comunidade e advogados que os representaram. Analisando as estratégias empregadas pela Comunidade na busca de seus direitos, bem como pela OSC Terra de Direitos na defesa judicial desses direitos, pude notar a criatividade, resiliência e senso de comunidade – bem como alguns dos fatores externos – que estão por trás do sucesso relativo dos quilombolas de Paiol na garantia de seus direitos constitucionais. Ademais, foi possível concluir que, embora represente o maior caso de avanço na titulação de terras quilombolas no Paraná, a Comunidade Paiol de Telha ainda está longe de usufruir plenamente dos direitos que lhe são garantidos pelo artigo 68 do Ato das Disposições Constitucionais Transitórias e reconhecidos pelo Laudo Antropológico homologado pelo INCRA em 2009 - situação que se deve, em parte, à morosidade do próprio INCRA/PR, do INCRA/PR, bem como de instituições governamentais federais e estaduais, em prover recursos financeiros e humanos para viabilizar a ocupação do território pelos membros da Comunidade.

Abstract: This case study aimed to analyze the struggle for land demarcation and titling, as well as the socio-environmental and land conflicts related to the Invernada Paiol de Telha Quilombola Community, located in the municipality of Reserva do Iguaçu, in the state of Paraná, through the lens of strategic litigation. The central objective of this research was to assess and report on the history of the Community's struggle and territorial expropriation, as well as the progress and developments of the administrative process for demarcating the community with INCRA, and the various political and legal conflicts that have arisen from the Community's factual and legal situation. The methodology used for this was a qualitative case study, based on a documentary analysis of the administrative process of demarcation and land titling being carried out by INCRA in relation to the Invernada Paiol de Telha Quilombola Community, as well as the court cases relating to the territorial rights of the Community's members - in addition to academic papers produced about the Community's situation, as well as on Quilombola communities in general. In addition, fieldwork was carried out by means of semi-structured interviews with members of the Community and the lawyers who represented them. In analyzing the strategies employed by the Community in the pursuit of their rights, as well as by OSC Terra de Direitos in the judicial defense of those rights, I was able to note the creativity, resilience and sense of community – as well as some of the external factors – behind the relative success of Paiol's quilombolas in securing their constitutional rights. Besides, I could conclude that, although it represents the greatest case of advance in the titling of quilombola lands in Paraná, the Paiol de Telha Community is still a long way from fully enjoying the rights guaranteed to it by article 68 of the Transitional Constitutional Provisions Act and recognized by the Anthropological Report ratified by INCRA in 2009 - a situation that is due partly to the slowness of INCRA/PR itself, as well as that of federal and state government institutions, in providing financial and human resources to make the occupation of the territory by the members of the Community viable.
