A responsabilidade civil e a bioética nas cirurgias plásticas estéticas

Abstract

Resumo: O presente trabalho de conclusão de curso visa analisar a responsabilidade civil e bioética nas cirurgias plásticas estéticas no contexto do Brasil. Inicialmente, é abordado o conceito de cirurgia plástica estética e o aumento desse fenômeno no país. Em seguida, são explorados princípios bioéticos, destacando os deveres éticos e profissionais dos profissionais que realizam esse tipo de procedimento, ressaltando a importância da informação e consentimento do paciente. O trabalho também discute os possíveis danos causados por intervenções estéticas e como a responsabilidade civil pode ser aplicada nesses casos, diferenciando obrigações de meio e obrigações de resultado. É apresentada a legislação brasileira referente a esse tema, bem como o viés doutrinário e jurisprudencial. Além disso, também são discutidos os direitos dos pacientes na busca por intervenções estéticas, destacando-se a importância da autonomia e da proteção à integridade física, psíquica e moral. Por fim, com base nas análises e reflexões realizadas, é concluído que a responsabilidade civil e a bioética têm forte relação no âmbito das cirurgias plásticas estéticas, reconhecendo o dever dos profissionais em zelar pela saúde e bem-estar dos pacientes, cumprindo as normas éticas e legais estabelecidas

Abstract: This thesis aims to analyze civil liability and bioethics in aesthetic plastic surgeries within the Brazilian context. Initially, it discusses the concept of aesthetic plastic surgery and the increasing prevalence of this phenomenon in the country. Next, it explores bioethical principles, highlighting the ethical and professional obligations of practitioners who perform such procedures, emphasizing the importance of patient information and consent. The study also addresses possible harms resulting from aesthetic interventions and how civil liability can apply in these cases, differentiating between obligations of means and obligations of result. Brazilian legislation on the topic is presented, as well as doctrinal and case law perspectives. Additionally, the rights of patients seeking aesthetic interventions are discussed, underscoring the importance of autonomy and the protection of physical, psychological, and moral integrity. Finally, based on the analyses and reflections conducted, the thesis concludes that civil liability and bioethics are closely related in the realm of aesthetic plastic surgeries, recognizing the professionals' duty to ensure the health and well-being of patients, in compliance with established ethical and legal standards
