Narrativas cinematográficas e transformações legislativas e jurisprudenciais : estudo crítico dos mecanismos pelos quais o cinema influencia os direitos humanos

Abstract

Resumo: Este estudo analisa como o cinema influencia transformações legislativas e jurisprudenciais, com foco nos Direitos Humanos. A hipótese central é que as representações cinematográficas não apenas refletem, mas também atuam como catalisadoras de mudanças no ordenamento jurídico, moldando a percepção pública e impactando decisões jurídicas. O trabalho explora como filmes retratam o sistema jurídico e questões sociais, investigando como essas representações podem promover mudanças legislativas e jurídicas. A pesquisa se concentra em três aspectos principais: (i) a relação entre cinema e a construção da percepção pública sobre o Direito e os Direitos Humanos, (ii) a contribuição do cinema para a alteração de leis e jurisprudência, e (iii) as implicações sociais e políticas dessas representações, observando como as narrativas cinematográficas influenciam a opinião pública e as decisões políticas e legislativas. Exemplos históricos de filmes que impactaram mudanças legislativas são analisados para ilustrar essa dinâmica. A metodologia adotada envolve a análise de filmes e produções audiovisuais que explorem questões jurídicas e sociais, com base em teorias da comunicação que explicam como as narrativas audiovisuais moldam a percepção social. O estudo também considera a manipulação do cinema em regimes autoritários e os desafios de usar o cinema como ferramenta de análise jurídica. Por fim, o trabalho investiga como as narrativas cinematográficas, ao convergirem estética, veracidade e ativismo, podem impulsionar mudanças jurídicas e promover a proteção dos Direitos Humanos globalmente

Abstract: This study analyzes how cinema influences legislative and jurisprudential transformations, focusing on Human Rights. The central hypothesis is that cinematic representations reflect and act as catalysts for changes in the legal system, shaping public perception and impacting judicial decisions. The work explores how films depict the legal system and social issues and investigates how these representations can promote legislative and judicial changes. The research focuses on three main aspects: (i) the relationship between cinema and the construction of public perception of Law and Human Rights, (ii) the contribution of cinema to the modification of laws and jurisprudence, and (iii) the social and political implications of these representations, examining how cinematic narratives influence public opinion and political and legislative decisions. Historical examples of films that have impacted legislative changes are analyzed to illustrate this dynamic. The adopted methodology involves analyzing films and audiovisual productions that explore legal and social issues based on communication theories explaining how audiovisual narratives shape social perception. The study also considers the manipulation of cinema under authoritarian regimes and the challenges of using cinema as a tool for legal analysis. Finally, the research investigates how cinematic narratives, by converging aesthetics, truthfulness, and activism, can drive legal changes and promote the protection of Human Rights globally
