Coação econômica

Abstract

Resumo: O tema da dissertação consiste em investigar, de maneira sistemática, a figura da coação no Direito Civil contemporâneo brasileiro, incluindo a hipótese de ameaça de ordem econômica. O objetivo central recai na verificação da aplicabilidade da coação econômica por meio do atual art. 151 e seguintes do Código Civil, na análise de seus elementos caracterizadores e das circunstâncias indicativas do vício. Para tanto, vale-se do exame da experiência brasileira e do Direito estrangeiro, sobretudo das figuras da economic duress (common law), e da violence économique (inserida no Código Civil francês pela reforma de 2016). A pesquisa conclui que a hipótese mais ampla da coação no ordenamento jurídico brasileiro abrange aquela decorrente de pressão econômica, incluindo relações interempresariais, mantendo-se o fundamento de preservação da liberdade, por meio de uma releitura hermenêutica de seus elementos caracterizadores. Pautando-se pela experiência estrangeira, os elementos da coação econômica resumem-se a: a) ameaça injusta, que frequentemente coincide com a ameaça abusiva do exercício de um direito; b) nexo de causalidade, em que se adota a teoria da conditio sine qua non; e c) ausência de alternativa razoável, tanto jurídica quanto extrajurídica. Além disso, a pesquisa aponta como circunstâncias indicativas do vício a serem analisadas no caso concreto: a) a dependência econômica; b) o desequilíbrio entre as prestações no negócio jurídico; c) as características da relação; e d) o comportamento do coato

Abstract: The subject of the dissertation is to systematically investigate duress in contemporary Brazilian civil law, including the hypothesis of economic threats. The main objective is to verify the applicability of economic duress through the current article 151 et seq. of the Brazilian Civil Code, by analyzing its characterizing elements and the circumstances that indicate the vice. To this end, it examines the Brazilian experience and foreign law, especially the figures of economic duress (common law), and violence économique (inserted in the French Civil Code by the 2016 reform). The research concludes that the broader hypothesis of duress in the Brazilian legal system encompasses that arising from economic pressure, including inter-company relations, while maintaining the foundation of preserving freedom, through a hermeneutic rereading of its characterizing elements. Based on foreign experience, the elements of economic coercion are summarized as: a) an unjust threat, which often coincides with the abusive threat of exercising a right; b) causation, in which the theory of conditio sine qua non is adopted; and c) the absence of a reasonable alternative, both legal and extra-legal. In addition, the research points to the following as circumstances indicating the vice to be analyzed in the specific case: a) economic dependence; b) the imbalance between the benefits in the legal transaction; c) the characteristics of the relationship; and d) the behavior of the victim
