Motoristas de cargas e plataformas digitais : novas modalidades de contratação do trabalho digital

Abstract

Resumo: Este estudo investiga a relação jurídica contratual dos motoristas profissionais que utilizam plataformas digitais de frete, focando no impacto dessas plataformas nas disputas jurídicas no Brasil. A pesquisa questiona como o trabalho mediado por plataformas digitais influencia as questões jurídicas envolvendo motoristas do transporte rodoviário de cargas. A análise é baseada na jurisprudência da Justiça do Trabalho sobre as relações de trabalho mediadas por plataformas. O objetivo geral é examinar as transformações nas relações de trabalho resultantes da utilização dessas plataformas para o transporte rodoviário de cargas, enquanto os objetivos específicos incluem: analisar a regulação da profissão de motorista no Brasil, investigar a introdução e a evolução das plataformas de frete e entender os impactos do trabalho plataforma nas disputas jurídicas. A metodologia é baseada em revisão bibliográfica. A conclusão aponta que o modelo de negócio das plataformas digitais representa uma mudança na organização do trabalho sem as proteções trabalhistas tradicionais. As possibilidades para a melhoria das condições de trabalho perpassam necessariamente pela organização coletiva dos trabalhadores, através da atuação dos sindicatos, das associações e dos coletivos de trabalhadores, uma vez que o caráter político do Direito do Trabalho necessita ser reafirmado através da participação dos trabalhadores dos processos decisórios e das redes de solidariedade formadas em contraposição à apropriação do próprio sentido do trabalho

Abstract: This study investigates the contractual legal relationship of professional drivers who use digital freight platforms, focusing on the impact of these platforms on legal disputes in Brazil. The research questions how work mediated by digital platforms influences legal issues involving drivers of road freight transport. The analysis is based on the jurisprudence of the Labor Court on employment relationships mediated by platforms. The general objective is to examine the transformations in employment relationships resulting from the use of these platforms for road freight transport, while the specific objectives include: analyzing the regulation of the driver profession in Brazil, investigating the introduction and evolution of freight platforms, and understanding the impacts of platform work on legal disputes. The methodology is based on a literature review. The conclusion points out that the business model of digital platforms represents a change in the organization of work without traditional labor protections. The possibilities for improving working conditions necessarily involve the collective organization of workers, through the actions of trade unions, associations and workers' collectives, since the political nature of Labor Law needs to be reaffirmed through the participation of workers in decision-making processes and solidarity networks formed in opposition to the appropriation of the very meaning of work
