Litígios estruturais e orçamento público

Abstract

Resumo: Esta dissertação busca analisar os litígios estruturais que envolvem omissões ou ações ineficientes da Administração Pública em políticas públicas a partir do campo do orçamento público, verificando ferramentas pertinentes a essa área com o objetivo de aprimorar o cumprimento de medidas estruturais. O primeiro capítulo dedica-se ao assentamento de premissas que auxiliam no recorte do tipo de litígios estruturais analisado, com especial dedicação ao comportamento do princípio da separação de poderes, do controle judicial de políticas públicas e na necessidade de disponibilidade financeira da Administração Pública para o cumprimento de medidas estruturais. No segundo capítulo, rememoram-se institutos do orçamento público pertinentes ao estudo dos litígios estruturais, partindo-se do arranjo típico de escolha de políticas públicas, que envolve escolhas trágicas por parte do gestor público, para chegar ao processo de planejamento orçamentário e de abertura de créditos orçamentários e adicionais. Por fim, no último capítulo pretende-se conjugar as necessidades anunciadas nos litígios estruturais, atinentes à formulação ou ampliação de políticas públicas, com mecanismos oriundos do orçamento público que apresentam o potencial de ampliar a efetividade no cumprimento de medidas estruturais.

Abstract: This dissertation aims to analyze structural disputes involving omissions or inefficient actions by the Public Administration in public policies, focusing on the field of public budgeting. It examines relevant tools in this area with the goal of improving the implementation of structural measures. The first chapter is dedicated to establishing premises that assist in defining the type of structural disputes analyzed, with special attention to the behavior of the separation of powers principle, judicial control of public policies, and the need for financial availability of the Public Administration to fulfill structural measures. In the second chapter, relevant public budgeting institutes are revisited in the study of structural disputes, starting from the typical arrangement of public policy choices, involving tragic choices by the public administrator, and progressing to the budget planning process and the opening of budgetary and additional credits. Finally, in the last chapter, the intention is to combine the needs identified in structural disputes, related to the formulation or expansion of public policies, with mechanisms derived from public budgeting that have the potential to enhance effectiveness in fulfilling structural measures.
