O controle judicial da não criação de comissões parlamentares de inquérito

Resumo: Ao longo dos anos o Supremo Tribunal Federal vem reafirmando sua jurisprudência no sentido de considerar que a criação de Comissões Parlamentares de Inquérito mediante os requisitos constitucionais é direito fundamental líquido e certo garantido às minorias parlamentares no exercício da atribuição constitucional de fiscalização e controle e que a ação ou omissão da maioria parlamentar que busque impedir o exercício deste direito é passível de judicialização. O presente trabalho buscou na literatura especializada responder sobre se o julgamento do Mandado de Segurança 37.760/DF de 2021 que determinou ao Presidente do Senado adotar as medidas necessárias para o adequado funcionamento da CPI da pandemia é compatível com a separação de Poderes, levando em consideração a estrutura jurídica das CPIs, a obstaculização do exercício do direito de oposição e a função da oposição em regimes democráticos. Abstract: Over the years, the Brazilian Supreme Court keep reaffirming its jurisprudence considering that the creation of parliamentary inquiry through constitutional requirements is a minority fundamental right in the exercise of oversight and control and the action or the omission from the majority of the parliament that try to prevent the exercise of this right is able to judicialization. This work sought in the specialized literature answer if the judgment of the writ of mandamus 37.760/DF de 2021 that forced the President of Senate to do the necessary steps for the right running of the pandemic parliamentary inquiry is compatible with the separation of powers , considering the juridical structure of parliamentary inquiry, the obstacle made by the majority of the parliament to the minority exercise its political opposition rights and the function of the opposition in democratic regimes.
