Gestantes no cárcere : análise das condições de vida das mulheres grávidas nas penitenciarias femininas brasileiras sob a perspectiva de vida precária de Judith Butler

Abstract

Resumo: O presente estudo se propõe a analisar a condição de vida das mulheres grávidas encarceradas no Brasil sob a perspectiva da precariedade, termo que será tratado a partir da definição apresentada por Judith Butler em Vida Precária: os poderes do luto e da violência. A fim de analisar a condição foi estudado o histórico do encarceramento feminino, o cenário brasileiro atual, as garantias previstas e como funciona a prática da maternidade no cárcere. As informações disponíveis sobre a situação das penitenciárias femininas se restringem, majoritariamente, a dados numéricos, então, para compreender o cotidiano do carcere para as gestantes e seus filhos, foram utilizados livros que narram as vivências dentro das penitenciárias que foram escritos a partir de relatos diretos das presas. Através de vertentes da criminologia buscou-se entender em qual contexto essas mulheres estão inseridas dentro do sistema penitenciário e como se dá a distribuição da precariedade em suas vidas. Por fim, entendeu-se que, apesar dos direitos fundamentais e garantias relacionados à maternidade, o cárcere não oferece condições para as mães poderem desenvolver o vínculo materno em sua completude e nem para o pleno crescimento dos filhos atrás das grades.

Abstract: The purpose of this study is to analyze the living conditions of pregnant women in prison in Brazil from the perspective of precariousness, a term that will be treated based on the definition presented by Judith Butler in Precarious Life: the powers of mourning and violence. In order to analyze the condition, we studied the history of female incarceration, the current Brazilian scenario, the guarantees provided and how the practice of motherhood in prison works. The information available on the situation in women's prisons is mostly restricted to numerical data, so in order to understand the day-to-day life in prison for pregnant women and their children, we used books that narrate the experiences inside prisons, which were written based on the direct accounts of the prisoners. Using criminological approaches, we sought to understand the context in which these women are inserted within the prison system and how precariousness is distributed in their lives. Finally, it was understood that, despite the fundamental rights and guarantees related to motherhood, prison does not offer the conditions for mothers to be able to develop the maternal bond in its entirety, nor for the full growth of their children behind bars.
