Herança digital em uma perspectiva civil-constitucional

Abstract

Resumo: A pesquisa trata de uma releitura das bases do Direito Sucessório para verificar sua suficiência no enfrentamento da sucessão de bens digitais, embora sejam necessários ajustes interpretativos que garantirão sua maior efetividade. Propõe-se um repensar conceitual da morte e da personalidade jurídica no âmbito de uma sociedade virtualizada. Descreve os bens digitais e sua classificação enquanto nova categoria de bens decorrente da virtualização da vida, a partir de sua natureza mutável e híbrida. Analisa as correntes doutrinárias que propõem a transmissão dos bens digitais a partir de casos concretos, apresentando uma terceira via através da aplicação da metodologia do Direito Civil-Constitucional. Enfrenta-se o tema da identidade digital póstuma e os principais desafios jurídicos de sua tutela, a exemplo do conflito de interesses que pode surgir entre o direito da personalidade do falecido e o direito à herança de seus herdeiros. O estudo apresenta soluções para os novos conflitos do Direito Sucessório trazidos pelos bens digitais, notadamente pelos bens híbridos, indo além do modelo binário clássico. Por fim, destaca-se a teoria do direito de acesso como titularidade capaz de promover um arejamento nos fundamentos teóricos que impõem uma escolha entre o patrimonial e o existencial, demonstrando a possiblidade de harmonização entre direitos outrora conflitantes.

Abstract: The research is a rereading of the foundations of inheritance law to verify the sufficiency in dealing with the succession of digital assets, although adjustments are necessary to ensure its best effectiveness. It proposes a new way of thinking about the concept of death and its relationship with legal personality in the context of a virtual society. It describes digital goods and their classification as a new category of goods resulting from virtual life, characterized by nature as mutable and hybrid. It analyzes the theoretical currents that study concrete cases that dealt with the inheritance of digital assets, to present a resolution method applied to constitutional civil law. It raises questions about the posthumous digital identity and the main legal challenges of its guardianship, such as the conflict of interests that may arise between the deceased's right to personality and the right to inheritance of his heirs. The study brings solutions to the new succession conflicts brought about by digital issues, notably by hybrid assets, going beyond the classic binary model. Finally, it highlights the theory of the right of access as ownership capable of promoting an update of the theoretical foundations that impose a choice between the patrimonial and the existential, demonstrating the possibility of harmonizing previously conflicting rights.
