Flexibilidade e expropriação do tempo de trabalho dos motoristas de aplicativo : análise sociojurídica sobre o trabalho prestado por meio de plataformas digitais

Resumo: O presente estudo propõe-se a analisar a questão do tempo de trabalho dos motoristas de aplicativo, isto é, trabalhadores sob o controle de plataformas digitais, sob a perspectiva da globalização econômica, do neoliberalismo e da flexibilidade. A intensificação da globalização a partir da década de 1970, especialmente na dimensão econômica, foi impulsionada pelo desenvolvimento de tecnologias de comunicação e transporte mais baratas e eficazes, culminando na criação de novas formas de organização de trabalho. O neoliberalismo, na condição de racionalidade sustentadora da globalização, e sua agenda econômica geram, no âmbito do Direito do Trabalho, a precarização de empregos e em flexibilização e homogeneização dos direitos trabalhistas. Neste contexto, ganha notoriedade a flexibilidade, que, em suas mais variadas facetas, pressupõe a ultravalorização da autonomia da vontade e de redução do Estado no âmbito social. Um dos exemplos desta conjuntura é o trabalho prestado por intermédio das plataformas digitais, que concebe um novo modelo de trabalho informal, flexível e sob demanda. Dentre as plataformas digitais existentes, destaca-se a Uber, que é tomada como exemplo no presente estudo. Há, assim, a transferência dos riscos do empreendimento ao trabalhador, ao mesmo tempo em que não há qualquer controle ou limitação de jornada. Sob a perspectiva da teoria do valor, a flexibilidade abre espaço para a expansão do capital, que tem a seu dispor o tempo da força de trabalho para alavancar a acumulação, de modo que tal expansão é amplificada pela flexibilização das horas laborais e, especialmente, pelo trabalho prestado sob o controle das plataformas. Sendo assim, objetiva-se investigar, a partir análise sociojurídica sobre a interconexão entre globalização econômica, neoliberalismo e flexibilidade laboral, as formas pelas quais o discurso neoliberal de flexibilidade permite o alargamento da expropriação do tempo dos trabalhadores de plataformas digitais e como este fenômeno está relacionado com as alterações promovidas pela Reforma Trabalhista de 2017 no Brasil. Dada a complexidade que envolve esta modalidade de trabalho, a análise utiliza-se do método de abordagem hipotético-dedutivo, a partir do exame teórico de literatura especializada sobre o tema, do método hermenêutico e da técnica de documentação indireta, de cunho bibliográfico, com caráter interdisciplinar e com fundamento na Sociologia, na Sociologia do Direito e na Sociologia do Trabalho, para além da dogmática jurídica, visando propiciar uma leitura mais complexa da problemática. A pesquisa apontou como resultado a visualização de cinco principais formas pelas quais o discurso neoliberal de flexibilidade permite a expropriação do tempo dos trabalhadores sob o controle das plataformas digitais no âmbito da economia globalizada, concluindo-se que o fenômeno da uberização é construído sob a égide da flexibilidade e, ao se operacionalizar sob demanda, consolida a figura do trabalhador just in time, cujo tempo de trabalho é deslocado para horários de trabalho mais convenientes segundo as exigências empresariais, em um ciclo submissão ao tempo de trabalho que representa, em última análise, precarização. Abstract: The study aims to analyze the working time matter for the app's drivers or the workers under control of digital platforms by the perspective of the economic globalization, neoliberalism and flexibility. The globalization increase, starting from the 70's, especially in its economic dimension was stimulated by the development of new communication and transportation technologies, more efficients and less expensive, leading to the development of new working organization forms. The neoliberalism, in it's condition of sustaining rationality for the globalization, and it's economic agenda generates, under the scope of Labor Law, a degradation of working posts, a flexibilization and homogenization of labor rights. In this context the flexibilization gains notoriety, assuming an ultravalorization of the autonomy of will and the State reduction. An example of this conjucture it's the forms of work that are provided by digital platforms, conceiving a new informal working model, flexible and on-demand. Among the existing digital platforms, Uber stands out, wich is presented as an example in this study. Therefore exists a transfer of the enterprise's risks to the worker at the same time that there is no control or limitation of working hours. Under the perspective of the value theory, the flexibility promotes the possibility of capital expansion that has at its disposal the work hours to increase accumulation, in a way that this expansion is amplified by the flexibility of labor hours and specially by the labor provided under the control of platforms. From what was exposed, the study aims to investigate, by the social and legal analysis of the interconnection between economic globalization, neoliberalism and labor flexibility, the means that the neoliberal speech allows the expropriation's increase of digital platforms workers time and how this phenomenon is related to the changes provided by the 2017 Brazilian Labor Reform. Given the complexity involved in this working modality, the analysis uses the hypothetical-deductive method of approach, from the theoretical examination of specialized literature on the subject, the hermeneutic method and from the indirect documentation technique, with bibliographic nature, interdisciplinar condition and based in Sociology, Law Sociology and Labor Sociology, beyond the legal dogma, in order to provide a more complex reading of the problem. The research pointed out as result to a indication of five main ways in wich neoliberal speech of flexibility allows the time expropriation of workers under the digital platforms control in the globalized economy scope, concluding that the uberization phenomenon is built under the aegis of flexibility and, when operating on-demand, consolidate the just in time worker figure, whose working time is dislocated to a Much more convenient working time according to business requirements, in a cycle of working time submission wich represents, ultimately, precarization.
