A sujeição do trabalhador ao mercado : entre o complexo de Édipo e a paixão pelo submisso

Abstract

Resumo: Esta dissertação se presta a investigar a situação de submissão do indivíduo trabalhador no contexto da racionalidade neoliberal, em específico, a partir do fim do século XX no Brasil. O ponto de partida da pesquisa é a compreensão das relações de trabalho típicas do sistema econômico capitalista, bem como a forma com a qual a figura do Estado manejou a proteção jurídica da classe trabalhadora utilizando de conceitos tipicamente liberais. A partir da concepção do contrato de trabalho, usado como instrumento jurídico de formalização das relações de exploração da força de trabalho humana, a doutrina juslaboral se apoiou no conceito da subordinação jurídica para justificar o estado de sujeição que se encontra o empregado nesse contexto. Todavia, a compreensão da subordinação do empregado ao empregador unicamente a partir do viés técnico do direito deixa de considerar os desdobramentos psíquicos responsáveis pelo fenômeno da submissão. Para trazer a subjetividade humana ao debate das relações de trabalho, o presente estudo utilizou o marco teórico da psicanálise freudiana, a qual oferece um novo olhar sobre a figura da autoridade e os motivos pelos quais os sujeitos a ela se submetem. Especialmente a partir dos conceitos psicanalíticos de Superego da cultura e de Pai Simbólico, esta pesquisa curvou-se sob a hipótese de que o mercado, figura central na racionalidade neoliberal, é a referência de autoridade à classe trabalhadora, fazendo com que o dever de obediência típico das relações de trabalho seja direcionado para a regras morais estabelecidas pelo capitalismo financeiro. Essas diretrizes, por sua vez, implicam em uma relevante quebra da solidariedade de classe, abrindo cada vez mais os caminhos para o desmonte das garantias fundamentais do trabalho estampadas na Constituição Federal de 1988. Por fim, sugere-se a retomada de um discurso de reconhecimento da subjetividade do outro, que permita o restabelecimento da solidariedade enquanto valor inegociável para o resgate dos objetivos fundamentais da República Federativa do Brasil previstos no artigo 3º da Constituição: a construção de uma sociedade livre, justa e solidária, o desenvolvimento nacional, a erradicação da pobreza com ênfase na redução das desigualdades sociais e regionais, e a promoção do bem de todos, sem discriminação.

Abstract: This dissertation has the goal to investigate the submissive situation of the working individual in the context of neoliberal rationality, very specifically from the end of the 20th century in Brazil. The starting point of this research is the understanding of the dynamics of labor relations typical to the capitalist economic system, as well as the way in which the figure of the State handled the legal protection of the working class using typically liberal concepts. Based on the conception of the employment contract, as a legal instrument for formalizing relations of exploitation of the human workforce, the labor law doctrine was based on the concept of legal subordination to justify the state of subjection that the employee finds himself in this relation. However, considering the subordination of the employee to the employer solely from a technical point of view, it fails to consider the psychological developments responsible for the phenomenon of submission. In order to bring human subjectivity to the debate on labor relations, the present study used the theoretical framework of Freudian psychoanalysis, which offers a new look at the figure of authority and the reasons why subjects submit to it. Borrowing from the psychoanalytic concepts of the Superego of culture and the Symbolic Father, this research was based on the hypothesis that the market, a central figure in neoliberal rationality, is the reference of authority to the working class, directing the duty of obedience typical of labor relations towards the moral rules established by financial capitalism. These guidelines, in turn, imply a significant break in class solidarity, opening up more and more ways to dismantle the fundamental guarantees of work enshrined in the 1988 Federal Constitution. Finally, we suggest the resumption of a debate about the acknowledgement of the other's subjectiveness, allowing the reestablishment of solidarity as a non-negotiable value, and for the rescue of the fundamental goals of the Federative Republic of Brazil foreseen in the 3rd article of the Constitution: the construction of a free, fair society solidarity, of national development, the eradication of poverty with an emphasis on reducing social and regional inequalities, and promoting the good for all, without discrimination.
