Inovações jurídicas no direito à saúde trazidas pela pandemia de COVID-19 no constitucionalismo multinível brasileiro

Resumo: O presente artigo discute o papel do Supremo Tribunal Federal (STF) e do Sistema Interamericano no enfrentamento da pandemia da COVID-19, com foco no Direito à Saúde. O Brasil tem sido um dos países mais afetados por essa emergência de saúde pública. Tanto o Sistema Interamericano quanto o STF têm desempenhado uma função fundamental no tratamento de questões relacionadas à pandemia, incluindo aquelas relacionadas à jurisdição, liberdade de expressão, saúde pública e direitos fundamentais. Tendo em vista a consolidação do Constitucionalismo Multinível no Brasil e na América Latina, parece necessário que qualquer análise jurídica que busque investigar os direitos fundamentais o faça a ótica daquele, levando em conta não apenas direito constitucional interno, mas também a sua comunicação indissociável com o direito internacional dos direitos humanos, concretizado através dos tratados e convenções internacionais, bem como do diálogo entre os cortes. Portanto, o eixo dialógico entre a Comissão Interamericana de Direitos Humanos, a Corte Interamericana de Direitos Humanos e o Supremo Tribunal Federal parece ser o foco essencial para qualquer análise acerca de direitos fundamentais no Brasil. Com isso em mente, este artigo teve como objetivo revisar as decisões e recomendações paradigmáticas sobre o Direito à Saúde tomadas pelo STF, pela Corte Interamericana de Direitos Humanos e pela Comissão Interamericana de Direitos Humanos, formuladas no contexto da pandemia durante os anos de 2020 , 2021 e 2022, a fim de trazer à tona seus principais fundamentos e reflexos no horizonte jurídico. Por essa ótica, percebeu-se que, após a pandemia, forma-se um novo horizonte do direito, cujo paradigma é o fortalecimento do diálogo entre tribunais, e a interseção entre convencionalismo e constitucionalismo na defesa dos direitos humanos, com o estabelecimento de um verdadeiro "ius constitutionale commune" na América Latina. Para além, notou-se a concretização de um Constitucionalismo Transformador nessa real Interamericanização do Direito Constitucional Brasileiro. Portanto, esse artigo analisa essa nova relação produzida no interior do Constitucionalismo Multinível, a fim de melhor interpretar o novo horizonte jurisprudencial para o qual o Direito está se movendo. Abstract: This article discusses the role of the Federal Supreme Court (STF) and the Inter-American System in facing the COVID-19 pandemic, focusing on the Right to Health. Brazil has been one of the countries most affected by this public health emergency. Both the Inter-American System and the STF have played a key role in addressing pandemic-related issues, including those related to jurisdiction, freedom of expression, public health, and fundamental rights. In view of the consolidation of Multilevel Constitutionalism in Brazil and Latin America, it seems necessary that any legal analysis that seeks to investigate fundamental rights should do so from the point of view of the former, considering not only internal constitutional law, but also its inseparable communication with the international human rights law, implemented through international treaties and conventions, as well as dialogue between courts. Therefore, the dialogical axis between the Inter-American Commission on Human Rights, the Inter-American Court of Human Rights and the Federal Supreme Court seems to be the essential focus for any analysis of fundamental rights in Brazil. With that in mind, this article aimed to review the paradigmatic decisions and recommendations on the Right to Health taken by the STF, the Inter-American Court of Human Rights and the Inter-American Commission on Human Rights, formulated in the context of the pandemic during the 2020s , 2021 and 2022, in order to bring out its main foundations and reflections on the legal horizon. From this perspective, it was noticed that, after the pandemic, a new horizon of law is formed, whose paradigm is the strengthening of dialogue between courts, and the intersection between conventionalism and constitutionalism in the defense of human rights, with the establishment of a true "ius constitutionale commune" in Latin America. In addition, it was noted the implementation of a Transforming Constitutionalism and a real InterAmericanization of Brazilian Constitutional Law. Therefore, this article analyzes this new relationship produced within Multilevel Constitutionalism, in order to better interpret the new jurisprudential horizon towards which the law is moving.
