Semipresidencialismo : a pertinência da implementação de um novo sistema de governo

Resumo: Reiteradas crises no cenário político brasileiro afetam as relações entre os Poderes, tornando a atuação de cada um deles crescentemente disfuncional. Fomentados pela literatura especializada e pelas crises institucionais, atores políticos debatem a adoção de um novo sistema de governo: o semipresidencialismo. Assim, o trabalho se propõe a verificar a pertinéncia da implementação desse novo sistema através da análise de temas relevantes como: a literatura em torno dos sistemas de governo; o histórico do presidencialismo no Brasil; e as propostas de adoção do semipresidencialismo, com especial atenção ao Relatório do Grupo de Trabalho Destinado a Analisar e Debater Temas Relacionados ao Sistema de Governo Semipresidencialista — GTSISGOV. Utiliza-se da análise da literatura para a definição de terminologia essencial e da análise de observação, através da doutrina e de documentos pertinentes, para identificar a relação entre o presidencialismo brasileiro e a crise vigente. O estudo leva a crer que o presidencialismo pode ser a causa de uma série de problemas. Essas mazelas tendem a se intensificar em países com experiências democráticas recentes ou com Executivos muito fortes — é o caso do Brasil. Uma retomada das turbulências que perpassam o cenário político brasileiro leva a crer que uma mudança é necessária. A proposta do Grupo de Trabalho apresenta soluções para grande parte das questões que fundamentam instabilidades durante toda a história brasileira. Diante das crises resultantes do acúmulo de competências pelo presidente, crescentes embates entre o Legislativo e o Executivo, ameaças à democracia, relativa ineficácia do procedimento de impeachment e seu alto custo político, o semipresidencialismo parece ser a resposta. A corresponsabilização, a convergência entre os poderes e a introdução da figura do primeiro-ministro como mediador representam uma saída viável e pertinente para o país. Abstract: Continued crises in the Brazilian political scenario affect the relations between the branches of government, making the performance of each increasingly dysfunctional. Encouraged by specialized literature and institutional crises, political actors discuss the adoption of a new system of government: semi-presidentialism. Thus, this study intends to verify the relevance of the implementation of this new system through the analysis of relevant issues such as: the literature on government systems; the history of presidentialism in Brazil; and the proposals for the adoption of semi-presidentialism, with special emphasis on the Report of the Working Group to Analyze and Debate Issues Related to the Semi-Presidentialist System of Government - GTSISGOV. To this end, it employs literature analysis to define essential terminology, and observation analysis, through doctrine and pertinent documents, to identify the connection between Brazilian presidentialism and the current crisis. The study leads us to believe that presidentialism may be the cause of a series of problems. These problems tend to intensify in countries with recent democratic experiences or with very strong executives, as is the case of Brazil. A review of the turbulence that pervades the Brazilian political scenario leads one to believe that a change is necessary. The Working Group's proposal presents solutions for most of the issues that have underpinned instability throughout Brazilian history. In the face of the crises arising from the accumulation of powers by the president, growing clashes between the Legislative and Executive branches, threats to democracy, the relative ineffectiveness of the impeachment procedure, and its high political cost, semipresidentialism seems to be the answer. Co-responsibility, convergence between the powers, and the introduction of the Prime Minister as a mediator represent a viable and pertinent solution for the country.
