A falta de atuação colegiada e a ausência de deliberação no Supremo Tribunal Federal à luz da teoria da integridade do direito de Ronald Dworkin

Resumo: O presente artigo tem como objetivo analisar duas das patologias institucionais que assolam o Supremo Tribunal Federal, quais sejam, sua falta de atuação colegiada e a ausência de deliberação entre seus membros à luz da Teoria da Integridade do Direito do jusfilósofo Ronald Dworkin, que defende a existência de um Direito análogo a um romance em cadeia, bem como de um sistema de Justiça no qual os magistrados têm a possibilidade de decidir e escrever novos capítulos do romance, contudo com respeito a essa integridade. Ademais, objetiva-se demonstrar que o déficit enfrentado pelo STF pode não ser uma causa direta do modelo seriatim, pois essa matriz apenas potencializa o baixo engajamento colegiado do Plenário. À vista disso, o que se busca é constatar a importância do julgamento colegiado para um Tribunal Constitucional como o STF, quais os principais pontos que contribuem para esses déficits e se a teoria da Integridade do Direito de Dworkin, mais especificamente no que concerne ao Direito análogo a um romance em cadeia, pode assessorar, ainda que parcialmente, na solução desses déficits. Por fim, busca-se uma solução prática, por meio de alterações no Regimento Interno do Supremo Tribunal Federal, com fundamento no Direito como um empreendimento literário, conforme defende Dworkin. Abstract: This article aims to analyze two of the institutional pathologies that plague the Federal Supreme Court, namely, its lack of collegiate action and the absence of deliberation among its members in the light of the Theory of Integrity of Law of the philosopher Ronald Dworkin, who defends the existence of a law analogous to a chain novel, as well as a justice system in which magistrates have the possibility to decide and write new chapters of the novel, however with respect for this integrity. Furthermore, the objective is to demonstrate that the deficits faced by the STF and studied here may not be a direct cause of the seriatim model, as this matrix only enhances the low collegiate engagement of the Plenary. In view of this, what is sought is to verify the importance of the collegiate judgment for a Constitutional Court such as the STF, what are the main points that contribute to these deficits and whether Dworkin's theory of Integrity of Law, more specifically with regard to Law analogous to a chain romance, can help, albeit partially, in solving these deficits. Finally, a practical solution is sought, through changes in the Internal Regulations of the Federal Supreme Court, based on Law as a literary enterprise, as defended by Dworkin.
