O papel do poder judiciário no contexto da "judicialização da saúde"

Resumo: Neste estudo, são abordados o caráter fundamental do direito à saúde, a partir da Constituição de 1988, bem como o papel do Poder Judiciário para resolução dos obstáculos à implementação desse direito no Brasil. A pesquisa, com enfoque descritivo, foi desenvolvida a partir de amplo referencial teórico, tanto para delimitações etimológicas quanto para a abordagem crítica de alguns dos obstáculos identificados para a referida implementação. O resultado dessa pesquisa foi dividido em quatro Capítulos específicos (4 a 7), dedicados a cada um dos obstáculos indicados no Capítulo 3. Tais capítulos também foram permeados com outras discussões pertinentes ao tema, como o ativismo judicial, o estado de coisas inconstitucional, a separação de Poderes e o acesso à Justiça. Constatou-se que a intromissão do Judiciário nos demais Poderes é, na maioria das vezes, legítima, dada a dificuldade de se tentar resolver defeitos sistêmicos na organização e execução de toda a infraestrutura associada ao fornecimento de medidas de saúde, mas não deve ser o caminho prioritário para solução de dificuldades desta natureza, que, infelizmente, é o que mostram os indícios nos últimos anos. Abstract: This study examines the fundamental character of the right to health, based on the 1988 Constitution, as well as the role of the Judiciary in resolving obstacles to the implementation of this right in Brazil. This research, with a descriptive approach, was developed from a broad theoretical framework, both for etymological delimitations and for a critical approach to some of the obstacles identified for the aforementioned implementation. The result of this research was divided into four specific Chapters (4 to 7), dedicated to each of the obstacles indicated in Chapter 3. Such Chapters were also permeated with other discussions relevant to the theme, such as judicial activism, the unconstitutional state of affairs, the separation of powers and access to justice. It was found that the interference of the Judiciary in the other Powers is, in most cases, legitimate, given the difficulty of trying to solve systemic defects in the organization and execution of the entire infrastructure associated with the provision of health measures, but it should not be the priority way to solve difficulties of this nature, which, unfortunately, is what the signs in recent years show.
