A realidade das medidas de segurança no Brasil

Abstract

Resumo: O seguinte trabalho busca analisar o instituto da medida de segurança no direito brasileiro, e julgar se ele se encontra em bom estado, tanto na legislação, doutrina e jurisprudência, quanto na aplicação em casos concretos, ou se é necessária reforma. Ao longo da pesquisa será estudado o conceito de medida de segurança e suas bases principiológicas, a legislação envolvendo o instituto, a história do instituto no direito mundial e no direito brasileiro. Em sequência, serão levantadas várias críticas realizadas pela doutrina referente à situação legal e teórica do instituto, apresentando a perspectiva de vários autores sobre temas diversos. Por último, serão comparados 3 Estabelecimentos de Custódia e Tratamento Psiquiátrico (ECTP), um no estado do Paraná, um no estado de Minas Gerais, e um no estado de Goiás, analisando as condições dos indivíduos em tratamento nessas instituições e a eficiência dos ECTPs em alcançarem seus objetivos.

Abstract: The following essay attempts to analyze the institute of safeguard measures in Brazilian Law, and judge if it finds itself in a good state, both in the legislation, doctrine and jurisprudence, and in the application in concrete cases, or if reform is necessary. Throughout this research the concept of safeguard measures will be studied, as well as its principled basis, the legislation involving the institute, the history of the institute in World Law and Brazilian Law. Following this, a plethora of criticism will be raised by the doctrine referring to the legal and theoretical situation of the institute, presenting the perspective of various authors about diverse themes. Lastly, 3 Custody and Psychiatric Treatment Institutes (CPTI) will be compared, one on the state of Parand, one on the state of Minas Gerais, and one on the state of Goias, analyzing the conditions of the individuals in treatment in these institutes and the efficiency of the CPTls in achieving its objectives.
