Resistência ao abolicionismo penal no Brasil : mídia enquanto barreira à mudança cultural e normativa punitivista

Resumo: O presente trabalho tem como objetivo entender como a mídia atua na manutenção do pensamento social punitivista, contribuindo para que a sociedade brasileira, principalmente àquela que não tem conhecimento sobre o sistema penal e de execução penal, veja esse sistema como a única alternativa possível para a resolução de conflitos penais, de forma que a opinião popular entenda totalmente inaceitável a abolição da pena privativa de liberdade, para adoção de medidas que sejam alternativas a ela. Para a construção deste trabalho foi realizada uma análise, olhando para o passado, do processo de escravidão no Brasil, onde corpos negros foram controlados e explorados de forma intensa e como esses 300 anos foram peças chaves para como o racismo atua na sociedade e como refletiu-se no sistema penal, encarcerando massivamente pessoas negras e pobres. Ainda, foi traçado uma linha do tempo em relação à evolução e desenvolvimento da mídia no Brasil, objetivando entender a forma como a mídia atua como agente de manutenção da cultura social punitivista. A metodologia utilizada foi a revisão bibliográfica e análise de algumas notícias e dados a fim entender o poder de influência que a mídia tem na sociedade. Assim, foi possivel verificar que essa influência se dá desde que se comegaram a disseminar noticias de casos criminais e ainda, que essa influéncia pode não só atingir individuos sem conhecimento juridico, como também operadores do Direito que podem formar opinido através da noticia recebida. Por fim, concluiuse que é necessaria uma mudanga de paradigma não somente do Direito Penal, Processual Penal e sistema penitenciário, mas deve-se haver uma mudança paradigmática na forma em que a mídia apresenta as informações. Abstract: The present work aims to understand how the media acts in the maintenance of punitive social thinking, confident that Brazilian society, mainly designated that does not have knowledge about the penal system and penal execution, sees this system as the only possible alternative for the resolution of criminal conflicts, so that popular opinion understands the abolition of the deprivation of liberty to be totally unacceptable, for the adoption of measures that accept alternatives to it. For the construction of this work, an analysis was carried out, looking at the past, of the process of slavery in Brazil, where black bodies were intensely controlled and exploited and how these 300 years were key pieces for how racism acts in society and how it reflected into the penal system, massively incarcerating black and poor people. Also, a timeline was traced in relation to the evolution and development of the media in Brazil, aiming to understand how the media acts as an agent for maintaining the punitive social culture. The methodology used was a bibliographic review and analysis of some news and data in order to understand the power of influence that the media has in society. Thus, it was possible to verify that this influence occurs as soon as news of criminal cases is disseminated and that this influence may not only reach individuals without legal knowledge, but also legal operators who can form an opinion through the news received. For me, it is concluded that a paradigm shift is necessary not only in Criminal Law, Criminal Procedure and the penitentiary system, but there must be a paradigm shift in the way in which the media presents information.
