O controle judicial de constitucionalidade de emendas constitucionais no Brasil : legitimidade, autoridade e justiça

Resumo: Casos como o da Ação Direta de Inconstitucionalidade (ADI) nº 5.017, em que se concedeu monocraticamente medida cautelar para suspender os efeitos de uma emenda constitucional promulgada com ampla maioria após mais de 10 anos de debate, suscitam reflexões acerca do paradoxo existente entre constitucionalismo e democracia. Se diversos autores colocam em cheque o controle de constitucionalidade de leis ordinárias, por ser uma prática que gera alguns déficits democráticos, o controle judicial de emendas e apresenta como um elemento ainda mais limítrofe neste debate: pode o Poder Judiciário rever até mesmo o ato democraticamente mais robusto emitido pelos poderes eleitos (a emenda constitucional)? No contexto brasileiro este tipo de controle é realizado desde antes da promulgação da Constituição da República de 1988 (CR). Porém, apesar de ser uma prática consolidada, a CR não parece ter conferido esta competência, ao menos não de maneira expressa, ao STF. Desta forma, me proponho neste trabalho a investigas a existência ou não de legitimidade da corte para a realização deste controle. Primeiramente, investigo o que fundamentou a criação histórica pelo STF do entendimento de que possui legitimidade para revisar judicialmente emendas constitucionais. Em suma, a corte baseia seu entendimento na existência de cláusulas pétreas no art. 60, §4º da CR, e também na inclusão das emendas constitucionais no termo "ato normativo", constante no art. 102, I, "a" da CR. Para investigar a correção ou não desta legitimidade, me proponho a trabalha-la em duas óticas diversas. A primeira (ex ante) é a ótica que separa teoria da autoridade e teoria da justiça, na qual busco, sem sucesso, a existência de algum fundamento expresso na CR que legitime o controle de emendas. A segunda (ex post) é a ótica da união entre teoria da autoridade e da justiça, em que busco investigar se há algum fundamento de legitimidade do controle de constitucionalidade de emendas baseado na probabilidade de que venha a produzir melhores resultados institucionais. Em suma, sob esta última ótica, não foi possível demonstrar com fundamentos teóricos que o controle seria legítimo. No entanto, verificou-se que o instrumento possui, inegavelmente potencialidades positivas, sobretudo no sentido de conferir um "contraponto" à opinião legislativa em uma rodada procedimental de diálogo. No entanto, tendo em vista o déficit dialógico e deliberativo da prática brasileira, é difícil imaginar um esquema em que o controle judicial de emendas não representasse a atribuição de uma última palavra judicial. No limite, ao menos, a pesquisa auxilia a desnudar vantagens e desvantagens deste tipo de controle, o que poderá auxiliar na pavimentação de caminhos que, ao menos, tornem mais democraticamente legítima prática. Abstract: Cases such as the Direct Action of Unconstitutionality nº 5.017, which granted monocratically provisional remedies in order to suspend the effects of a constitutional amendment promulgated with majority support, product of more than 10 years of debate, bring reflections on the paradox between constitutionalism and democracy. Considering that several authors put at stake the judicial review of ordinary legislation, understanding it as a practice that generates deficits, the judicial review through amendments is presented as an element in the borderline of the debate: does the Judiciary have jurisdiction to review even the most democratic act issued by the elected powers (a constitutional amendment)? In Brazil, this form of review is performed since before the promulgation of the 1988 Constitution (CR). However, despite being a common practice, the CR has not expressly conferred this jurisdiction to the Supreme Court. Thus, I propose to investigate the Court legitimacy to exercise this review control. Firstly, I investigate the Supreme Federal Tribunal (STF)'s historical creation of its legitimacy to review judicially constitutional amendments. In brief, the Court bases its judicial review jurisdiction on the existence of entrenched clauses in art. 60, §4º of the CR, and also in the inclusion of constitutional amendments in the term "normative act", contained in art. 102, I, "a", CR. In order to understand if this legitimacy is found, and in which levels, I propose to work in two different perspectives: the first one (ex ante) is the optics that separates the theory of authority from the theory of justice, in which I seek, unsuccessfully, for explicitly foundation in the CR that legitimates the jurisdiction over the amendments. The second one (ex post), is an optic of the union between theory of authority and justice, in which I aim to investigate the existence of issues in the legitimacy of the jurisdiction for the judicial review based on the hypothesis of presenting better institutional results. Briefly, from this last point of view, it was not possible to demonstrate on theoretical grounds the legitimacy of the judicial review. However, I identified that this instrument undeniably has positive potential, particularly in providing a "counterpoint" to legislative opinion in a procedure of dialogue stage. At the same time, given the dialogical and deliberative deficit in Brazil, it is difficult to imagine that the judicial review would not represent the attribution of a judicial final word. Therefore, this research provides the possibility to observe the advantages and disadvantages of this type of judicial review, and thus can assist in paving paths that, at least, can contribute to a more democratically legitimate practice.
