Os direitos autorais na dança : em busca do eixo para equilíbrio entre a proteção dos autores e o acesso à cultura

Resumo: Os direitos autorais constituem garantia constitucional, sendo defendido por muitos tanto como proteção ao artista e seu trabalho como, também, como instituto essencial para o incentivo à produção artística. O presente trabalho busca identificar como tal direito é aplicado à dança. Inicialmente, faz-se uma breve análise histórica para limitação do objeto de pesquisa, limitando o escopo à dança clássica, moderna e contemporânea. Identifica-se, assim, a configuração da obra autoral nessas vertentes da dança, a partir de uma análise dos processos criativos que resultam na coreografia e, para além, no espetáculo final. Passa-se, então, a avaliar a aplicação dos direitos autorais sobre os produtos criados, bem como seu impacto tanto com relação à coreografia, quanto ao espetáculo de dança. Na coreografia, são apresentados os requisitos legais para que a obra seja considerada apta para proteção de direitos autorais e principais casos jurídicos que a envolvem. Quanto ao espetáculo, observa-se a importância de cada elemento para o resultado final e a necessidade de uma proteção contratual resguarde os direitos autorais de cada artista ao mesmo tempo que garante a integridade da obra final. Por fim, discorre-se sobre o descompasso entre a proteção autoral tradicional e a realidade da produção artística contemporânea, na qual é essencial o olhar sobre o direito de autor como parte da sistemática constitucional, em que o direito fundamental de acesso à cultura deve não apenas ser garantido, mas também incentivado. Assim, no contexto da dança, expõe-se a necessidade de equilíbrio entre os interesses de todos os autores envolvidos na criação do espetáculo, a fim de que o público não seja privado da obra em decorrência de um eventual abuso de direito. Abstract: It is well known that copyright constitutes a fundamental guarantee to the artist's intellect, as well as an essential institute for encouraging artistic production. The present work seeks to identify how this right is applied to dance. Initially, a brief historical analysis is made to limit the research object, limiting the scope to classical, modern and contemporary dance. Thus, the configuration of the authorial work in these aspects of dance is identified, based on an analysis of the creative processes that result in the choreography and, beyond, in the final show. Then, the application of copyright on the products created is evaluated, as well as its impact in terms of both the micro (choreography) and the macro (spectacle). In the choreography, the legal requirements for the work to be considered suitable for copyright protection and the main legal cases involving it are presented. As for the show, the importance of each element for the final result is observed, as well as the need for contractual protection to protect the copyright of each artist while guaranteeing the integrity of the final work. Finally, it discusses the mismatch between traditional copyright protection and the reality of contemporary artistic production, in which it is essential to look at copyright as part of the constitutional system, in which the fundamental right of access to culture must not only be guaranteed, but also encouraged. Thus, in the context of dance, the need to balance the interests of all authors involved in the creation of the show is exposed, so that the public is not deprived of the work as a result of an eventual abuse of rights.
