Convênios administrativos e a boa-fé entre entes públicos

Resumo: O convênio administrativo é um instrumento para concretização de interesse comum, em regime de mútua cooperação, entre entes estatais ou entre esses e entes privados. Constata-se, no entanto, que a doutrina administrativa tradicional não é suficiente para explicar a realidade dos ajustes cooperativos firmados pelo poder público e é inapta quando se trata da solução de problemas complexos relacionados aos acordos cooperacionais. O objetivo deste trabalho é efetuar uma reanálise da teoria administrativista sobre convênios administrativos, pelo prisma da boa-fé objetiva, e, consequentemente, apresentar suporte teórico para o enfrentamento de adversidades que envolvem o tema, bem como elaborar uma descrição jurídica coerente sobre os ajustes firmados entre entes públicos. A partir da experiência doutrinária e jurisprudencial acerca do conceito de boa-fé civilista, foram analisadas situações reais e hipotéticas que envolvem as relações conveniais, o que viabilizou o desenvolvimento de soluções para problemas eventualmente enfrentados. Identificou-se que a teoria administrativa convenial sob a perspectiva do princípio da boa-fé objetiva é apta a explicar juridicamente situações fáticas não abordadas pela doutrina jurídico administrativa tradicional, como as hipóteses de quebra da confiança legítima, a demarcação de responsabilidade dos partícipes quando há desvio de objeto, o uso abusivo do poder de barganha, os limites do direito de denúncia, e o reconhecimento de relação jurídica antes e após a vigência convenial. Abstract: The administrative agreement is an instrument for achieving a common interest, in a regime of mutual cooperation, between state entities or between these and private entities. It appears, however, that the traditional administrative doctrine is not enough to explain the reality of cooperative arrangements signed by the government and is inapt when it comes to solving complex problems related to cooperative agreements. The objective of this work is to carry out a reanalysis of the administrative theory on administrative agreements, through the prism of objective good faith, and, consequently, to present theoretical support for the confrontation of adversities that involve the theme, as well as to elaborate a coherent legal description about the adjustments signed between public entities. Based on the doctrinal and jurisprudential experience about the concept of civilist good faith, real and hypothetical situations involving contractual relationships were analyzed, which enabled the development of solutions to problems eventually faced. It was identified that the contractual administrative theory from the perspective of the principle of objective good faith is able to legally explain factual situations not addressed by the traditional doctrine, such as the hypotheses of breach of legitimate trust, the demarcation of responsibility of the participants when there is a deviation of object, the abusive use of the power of persuasion, the limits of the right of denunciation, and the recognition of legal relationship before and after the contractual validity.
