As religiões e a democracia em cabo-de-guerra : uma análise acerca do significado constitucional da laicidade

Resumo: O presente trabalho, em seu cerne, questiona: será que a tutela constitucional do princípio da laicidade, tomada sob o manto teórico da liberal-democracia, oferece efetiva solução ao problema da incursão religiosa sobre o campo político? Nesse contexto, ele parte de uma inquirição interdisciplinar acerca do conceito possivelmente atribuível à laicidade, por vezes tratada como simples secularidade, para avançar à investigação semântica dos sentidos que lhe são constitucionalmente extraídos. Sob o prisma metodológico, a revisão bibliográfica é confrontada com exigência específicas do método comparatista, a fim de resguardar as diferenças contextuais entre os diferentes ordenamentos analisados. O exame de decisões proferidas pelo Supremo Tribunal Federal também ganha relevo, como ferramenta indispensável à extração de possibilidades semânticas para a interpretação da laicidade. A segunda parte do trabalho, ao seu turno, propõe investigar, especificamente, a tutela constitucional da vida religiosa pública, problematizando-a. Há particular devoção à questão do retrocesso democrático, colocado enquanto relevante movimento de abertura a novos autoritarismos, muitos dos quais vocalizadores de bandeiras religiosas excludentes. Dessa forma, a laicidade é finalmente tensionada sob as bases de seu paradoxal compromisso com a liberdade religiosa e o pluralismo democrático. Se a resposta separatista parece sedutora, o presente trabalho culmina propondo cautela. Partindo da concepção de um pluralismo agonístico, a laicidade pode ser vista menos enquanto uma solução estática para tornar incomunicáveis duas esferas distintas, e mais enquanto um caminho negocial, e justamente por isso precário, de harmonização entre seus dois valores fundantes. Abstract: The present essay, at its core, questions: can the constitutional protection of a laicity principle, taken under the theoretical framework of liberal democracy, offer an effective solution to the problem of religious incursion over the political field? Within this context, it begins with an interdisciplinary inquiry regarding the concept possibly attached to laicity, at times inferred simply as secularity, to then advance the semantical investigation of the concepts that can be constitutionally extracted from it. Under a methodological prism, the bibliographical review is confronted with the specific demands of the comparatist method, to safeguard de contextual differences between the different orders studied. The examen of decisions from the Brazilian Supreme Court is also relevant, as an indispensable tool to the mining of semantical possibilities that aid the interpretation of laicity. The second part of the work, in its turn, proposes to investigate the constitutional tutelage of public religious life, allowing its problematization. There is a particular devotion to the question of democratic backsliding, understood as a relevant movement allowing for new authoritarianisms, many of which support exclusionary religious discourses. Therefore, laicity is finally tensioned under the bases of its paradoxical compromise with religious freedom and democratic pluralism. If the separatist answer may seem seductive, the present essay culminates proposing caution. From the concept of a agonistic pluralism, laicity can be regarded lass as a statical solution to turn the two different fields incommunicable, and more as a negotiable way, and henceforth precarious way, of harmonization between its two core values.
